HomeMy WebLinkAboutMINUTES - 12041984 - 1.19 //9,A ORDINANCE NO. 84- 64 -------------------- (Abandoned Vehicle Abatement ) The Contra Costa County Board of Supervisors ordains as follows (omitting the parenthetical footnotes from the official text of the enacted or amended provisions of the County Ordinance Code) : SECTION I . Section 430-2 . 004 of the County Ordinance Code is amended, - 430_2 . 004 Authorityi_findingst_nuisance_ ( a) Authority. This division is enacted pursuant to California Vehicle Code Sections 22660 , 22661 , 226629 22665 , and Government Code Section 25845 . (b) Findings_ The board finds and declares that the accumu- lation and storge of abandoned, wrecked, dismantled , or inopera- tive vehicles or parts thereof on private and public property not including highways creates a condition tending to reduce the value of private property, to promote blight and deterioraton, to invite plundering, to create fire hazards , to consititute an attractive nuisance creating a hazard to the health and safety of minors , to create a harborage for rodents and insects , and to be injurious to the public health , safety and general welfare. (c) Nuisance . The presence of an abandoned, wrecked , dismantled, or inoperative vehicle or parts thereof , on private or public property not including highways , except as expressly hereinafter permitted , constitutes a public nuisance presenting an immediate threat to public health and safety which may be abated as such in accordance with the provisions of this division and code. (Ords . 84- 64 91 , 77-112 . ) SECTION II . Section 430-6. 008 is added to the Ordin+ince Code, to provide for abatement of inoperable vehicles which are incapable of being towed and valued at less than $200 , to read : 430_6. 008 . InoQerable_non_towable-Vehicles . -- - - - - --- ---- - --- (a) This chapter ' s notice of intention is. not required for removal of a vehicle or part thereof which is inoperable due to the absence of a motor , transmission , or wheels and incapable of being towed , and is valued at less than two hundred dollars ( $200 ) by a person specified in the Vehicle Code Section 22855 , provided that the property owner has signed a release authorizing removal and waiving further interest in the vehicle or part thereof . Prior to final disposition under Vehicle Code Section 22662 of such a low-valued vehicle or part for which evidence of registration was recovered, the C.H.P. shall provide notice to the registered and legal owners of intent to dispose of the vehicle or part , and if the vehicle or part is not claimed and removed within 12 days after the notice is mailed, from a location specified in Vehicle Code Section 22662 , final disposition may proceed. The County, C.H.P. or any contractor thereof shall not be liable for damage caused to a vehicle or part thereof by removal pursuant to this section . ORDINANCE NO. 84-64 -------------------- 00 72 (b) This section applies only to inoperable vehicles located upon a parcel that is (1 ) zoned for agricultural use or (2) not improved with a residential structure containing one or more dwelling units . Calhoun Board Chair [SEAL] VJW: df (11-5-84 ) -2- 00 73 ORDINANCE NO. 84- 64 -------------------- ORDINANCE 84/63 (Jurors Fees) The Contra Costa County Board of Supervisors ordains as follows (omitting the parenthetical footnotes from the official text of the enacted or amended provisions of the County Ordinance Code) : SECTION I . Section 28-4 . 002 of the County Ordinance Code is amended, to change its title from "Compensation" to "Grand jurors' comnensation" , to read: 29-4 . 002 Grand jurors compensation. (a) Per Diems. Each grand juror shall be paid ten dollars for attending each meeting of the jury and ten dollars for attending each meeting of its committees, but not more than one of each ten dollar per diems in any one 24-hour period from six a.m, to six a.m. the following day. (b) Expenses. Each grand juror shall be reimbursed for actual, necessary, and reasonable expenses (including mileage) , at the same rates as for county commissions. (Ords. 84- §11 81-73 §11 81-62 51 : Government Code §68091; see also Penal C. 890 and former Govt. C. 976009) . SECTION II . Section 28-4 . 004 is added, to provide for trial juror per diem fees, to read: 28-4 . 002 Trial jurors compensation. The fee for trial jurors in all superior, municipal and justice courts in this County, in all civil and criminal cases, shall be ten dollars for each day' s attendance as a juror. (Ord. 84- 52: Code of Civil Procedure §196 and Penal Code §1143) . SECTION III . EFFECTIVE DATE. This ordinance becomes effec- tive 30 days after passage, and within 15 days after passage shall be published once, with the names of the supervisors voting for and against it, in the Contra Costa Times a newspaper published in this County. Calhoun Board Chair [SEAL] ORDINANCE NO. 84/63 00 74 Juror I s Fees 1 ORDINANCE NO. 84-62 (Five Member Assessment Appeals Board) The Contra Costa County Board of Supervisors ordains as follows (omitting the parenthetical footnotes from the official text of the enacted or amended provisions of the County Ordinance Code) : SECTION I: Section 26-10. 204 of the County Ordinance Code is amended to provide for a five member assessment appeals board, to read: 26-10 . 204 . Membership, Qualifications , Term. (a) Membership: The assessment appeals board shall consist of five members appointed directly by the board of supervisors , acting only by three member panels designated from time to time by the clerk of the assessment appeals board. Approval of each member shall be by majority vote of the board of. supervisors. (b) Qualifications and Terms: The members ' qualifi- cations and terms of office shall be as provided by Revenue and Taxation Code Sections 1620ff, provided that the members shall be assigned terms in such a manner that the terms of no more than two offices shall expire in any one year . (Ord. 84- 62 51; 73-45 §1 (part) , 1973 ; R&TC §1622 . 1) SECTION II : Section 26-10. 206 of the Countv Ordinance Code (assessment appeals board alternates) is repealed. SECTION III : Section 26-10. 207 of the County Ordinance Code assessment appeals board direct appointments) is amended to read : 26-10. 207 . Direct .Appointment . After January 1 , 1975, the board of supervisors shall appoint members to the assessment appeals board upon the expiration of any term of office or the occurrence of a vacancy. (Ords. 84- 62 §3; 74-57 §1; R. &T.C . §1623 . 1) SECTION IV: Section 26-10 . 208 of the County Ordinance Code (assessment appeals board vacancies) is amended to read: 26-10. 208. Vacancies. Anyone appointed to fill a vacancy on the assessment appeals board shall serve for the remainder of the unexpired term. (Ords. 84- 62 94 ; 80-203; 73-45; R. &T.C. 91623 . ) SECTION V: Section 26-10. 210 of the County Ordinance Code (assessment appeals board pay and expenses) is amended to read: 26-10. 210. Pay and Expenses. (a) Each member of the assessment appeals board shall receive compensation for his services as set by board of supervisors resolution from time to time. (b) Each member of the assessment appeals board shall also be reimbursed for mileage and other expenses reasonably and necessarily incurred in the discharge of his duties, as provided for regular county employees. (Ord. 84- 62 95; 74-57 52; 73-45 . ) 00 75 1 SECTION VI : Effective Date. This ordinance becomes effective January 1 , 1985 or thirty days after passage , whichever is later , and within 15 days after passaqe shall be published once, with the names of the supervisors votinq for and against it, in the Contra Costa Times a newspaper published in this county.
