HomeMy WebLinkAboutRESOLUTIONS - 08151989 - 89-544 (2) T.9 MR THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA DATE: August 15, 1989 MATTER OF RECORD --------------------------------------------=------------------------ --------------------------------------------------------------------- SUBJECT: Proposed 1989 Revision to the County Solid Waste Management Plan This being the time fixed for hearing on the proposed 1989 Revision to the County Solid Waste Management Plan. Harvey Bragdon, Director of Community Development Department, explained the procedures before the Board this date. David Okita of the Community Development Department Environmental Division described the proposed Plan. He noted that the Plan also contains landfill sites and reserve sites to be included in the General Plan Amendment. He advised that the Plan was reviewed by the Solid Waste Commission and that Commission recommends that the Board approve the Plan. The Chair declared the hearing open. The following persons appeared and commented: Jim Hulsoff, Vice Chair of the Solid Waste Commission Brian Kruse, Brentwood Don Seferovich, 16800 Marsh Creek Road, Clayton, speaking for the Marsh Creek Association Barbara Price, Council member of the City of Antioch Linda Callon, of Berliner, Cohen, & Biagini, Ten Almaden Boulevard, San Jose, representing the City of Antioch, East Bay Regional Park District and the Contra Costa Water District Thomas H. Lindenmeyer, 11500 Skyline Boulevard, Oakland, representing the East Bay Regional Park District Dennis Pisila, 1331 Concord Avenue, Concord, representing the Contra Costa Water District Fred Caploe, Attorney, 2530 Arnold Drive, Suite 360, Martinez, representing the City of Pittsburg, submitted two letters for the record and indicated that he would make arrangements with County Counsel to make reductions of the picture exhibits displayed in the Board Room today part of the record. (No exhibits received by the Clerk) Dr. C. Michael Hogan, Earth Metrics Incorporated, 2855 Campus Drive, Suite 300 , San Mateo, representing the City of Pittsburg, submitted a 4-page letter dated August 15, 1989 . Dr. Theodore V. Tronoff, Tronoff Engineers and Planners, 5850 .Shellmound Street, Emeryville, representing the City of Pittsburg, submitted a copy of his August 15 , 1989 letter to Attorney Fred Caploe on the subject: "City of Pittsburg - Contra Costa County Solid Waste Management Plan Final Environmental Impact Report, Response Document. " Dan Parker, 6363 Christie, #1507, Emeryville, representing the City of Pittsburg, submitted a pictorial report entitled: "Proposed Keller Dump, Visual Impacts on the City of Pittsburg. " Ron Currie, 4270 Diehl Way, Pittsburg, Councilman for the City of Pittsburg Robert Lewis, 50 Hawthorne Lane, Pittsburg, speaking for the Pittsburg Community Advisory Commission Harry Alker, 2010 Railroad Avenue, Pittsburg, speaking for the Pittsburg Chamber of Commerce Tom Bruen, representing the Keller Canyon Landfill Company Dr. Jill Shapiro, leader of project engineers and design team for Keller Canyon Landfill Company, showed slides of the proposed landfill Tom Reilly, 950 Waterbird Way, Martinez, speaking for Acme Fill Corporation John Hawthorne, 2241 Westwood Lane, Pittsburg Fred Caploe, Attorney for the City of Pittsburg, requested that this hearing be continued to provide for the consultant the opportunity to respond to new information provided today. County Counsel clarified that most of Mr. Caploe' s comments are to the General Plan, not the matter before the Board today. No one else desired to speak. Harvey Bragdon recommended that the hearing be closed and the Board take action today. Supervisor Torlakson advised that he supports the basic plan but has trouble with most of the sites except for the Marsh Canyon site. He commented that he believed that landfills must be kept away from cities and homes, and that he would not be supporting the motion to approve the staff ' s recommendation, because he could not support four out of the five sites. Supervisor McPeak advised that she would vote in support, but that she was vehemently opposed to the Kirker Pass site. Supervisor Fanden advised that although she did not favor all of the sites, it is imperative that the Board proceed and go forward in moving the CoSWMP along to the Cities for approval. The Board thereupon adopted Resolution No. 89/544. T.9 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CAUFORNIA Adopted this Order on August 15. 1989 , by the following vote: AYES: Supervisors Powers, Fanden and McPeak NOES: Supervisor Torlakson ABSENT: Supervisor Schroder ABSTAIN: None SUBJECT: Resolution Declaring the RESOLUTION NO. 89/ 554 Board's Intent To Approve Proposed 1989 Revision to the CoSWMP and Submitting Proposed Revision To Cities (14 C.C.R. , S 17147 ) The Contra Costa County Board of Supervisors RESOLVES THAT: 1. As required by the Nejedly-Z'Berg-Dills Solid Waste Management and Resource Recovery Act of 1972 (the "Act" ) and related regulations, the County has prepared the final draft of the proposed 1989 Revision to the County Solid Waste Management Plan (the "CoSWMP Revision" ) . 2. In conjunction with the preparation of the proposed 1989 CoSWMP Revision, the County has prepared a Draft Environmental Impact Report, has held a hearing on the Draft EIR before the Zoning Administrator in accordance with the County's CEQA Guidelines, and has prepared a Final Environmental Impact, comprising the Draft EIR and a Response Document containing a list of persons, organizations, and public agencies commenting on the Draft EIR, and responses to significant environmental points raised in the review and consultation process . 3. On this date the Board, after due notice, held a public hearing at which the Board heard comments from the public and County staff on the final draft of the proposed 1989 CoSWMP Revision. 4. The Solid Waste Commission has reviewed the proposed 1989 CoSWMP Revision and recommends that it be approved by the County and the cities of the County. 5. The Director of Community Development recommends that the Board certify the Final Environmental Impact Report, submit the proposed 1989 CoSWMP Revision to the cities in the County, and declare its intent to approve the proposed 1989 COSWMP Revision upon its approval by a majority of the cities in the County which contain a majority of the population of the incorporated area of the County. 6. Therefore, The Board hereby CERTIFIES that: (a) the Final Environmental Impact Report for the proposed 1989 CoSWMP Revision has been completed in compliance with the California Environmental Quality Act, as recommended by the County Zoning Administrator; and (b) the Final Environmental Impact Report was presented to the Board and the Board has considered the information contained in it. -1- RESOLUTION NO. 89/ 554 7 . The Board FINDS that the proposed 1989 CoSWMP Revision satisfies the requirements of the Act and reflects the County's policies and plans regarding the management of solid waste. 8. In accordance with the Act and related regulations, the Board hereby SUBMITS the proposed 1989 CoSWMP Revision to each of the cities in the County and STRONGLY RECOMMENDS that each of the cities approve it. 9 .
