HomeMy WebLinkAboutRESOLUTIONS - 09201988 - 88-600 Recorded at she request of: /. / Contra Costa County Return to: Public Works Department Records Section THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on September 20, 1988 by the following vote: AYES: Supervisors Powers , Fanden; McPeak, Torlakson & Schroder NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO. 88/600 SUBJECT: Completion of Improvements, Approving Subdivision Agreement, and Declaring Certain Roads as County Roads, Subdivision 6670, Pleasant Hill Area. The Public Works Director having reported that the developer of Subdivision 6670 has requested the subdivision improvements be split up into two phases and that Phase I has been completed as provided in the Subdivision Agreement with Desco Oakpointe and that a subdivision agreement with Perpetual Asset Management Company will cover the subdivision improvements in Phase II. The following document was presented for Board approval this date: A Subdivision Agreement with Perpetual Asset Management Company, subdivider, whereby said subdivider agrees to complete all improvements in Phase II as required in said Subdivision Agreement within one year from the date of said agreement; ` Said documents were accompanied by: I. Security to guarantee the completion of Phase II road and drainage improvements as required by Title 9 of the County Ordinance Code, as follows: A. Cash deposit (Auditor's Deposit Permit No. 136012, dated February 11, 1988) in the amount of $1, 000 made by Home Federal Savings and Loan. B. Additional security in the form of a corporate surety bond dated December 23 , 1987, and issued by Allied Mutual Insurance Company (Bond No. BD 7900521008) with Perpetual Asset Management Company, as principal, in the amount of $44,200 for faithful performance and $ 22 , 600 for labor and materials. NOW THEREFORE BE IT RESOLVED that the improvements in Phase I have been COMPLETED as of August 26, 1988 thereby establishing the six month terminal period for the filing of liens in case of action under said Subdivision Agreement with Desco Oakpointe: DATE OF AGREEMENT (PHASE I) SURETY October 28, 1986 Developer' s Insurance Company Bond No. 932167S RESOLUTION NO. 88/600 BE IT FURTHER RESOLVED that the widening of Oak Road and Walden Road is ACCEPTED and DECLARED to be a County road; the right of way was dedicated for public use on the Final Map of Subdivision 6670 filed on November 4, 1986 in Book 308 of Maps at page 20 of Official Records. BE IT FURTHER RESOLVED that the beginning of the one year warranty period is hereby established, and the $1, 500 cash deposit (Auditor's Deposit Permit, No. 115332, dated October 21, 1986) made by Desco Oakpointe be RETAINED for one year pursuant to the requirements of Section 94-4.406 of the Ordinance Code. BE IT FURTHER RESOLVED that said Subdivision Agreement is also APPROVED. 1 hereby certify that this Is a true and correct copy of an action taken and entered on the minute3 of the Board of Supervisors on the date shown.
