SUBJECT: Approval of the Final Map and Subdivision Agreement for
Subdivision 7040, Danville Area.
The following documents were presented for Board approval =.
this date:
The Final Map of Subdivision 7040, property located in the
Danville area, said map having been certified by the proper
officials.
A Subdivision Agreement with Dame' Construction Company,
Inc. , subdivider, whereby said subdivider agrees to complete all
improvements as required in said Subdivision Agreement within one
year from the date of said agreement.
Said documents were accompanied by:
I. Security to guarantee the completion of road and
drainage improvements as required by Title 9 of the
County Ordinance Code, as follows:
A. Cash deposit (Auditor's Deposit Permit No. 143302 ,
dated July 19, 1988) in the amount of $21, 100 made
by Dame' Construction Company, Inc.
B. Additional security in the form of a corporate,
surety bond dated June 21, 1988, and issued by
Reliance Insurance Company (Bond No. B463016) with
Dame' Construction Company, Inc. , as principal, in
the amount of $2, 090, 500 for faithful performance
and $1, 055,800 for labor and materials.
II. Letter from the County Tax Collector stating that there
are no unpaid County taxes heretofore levied on the
property included in said map and that the 1987-88 tax
lien has been paid in full and the 1988-89 tax lien,
which became a lien on the first day of March, 1988, is
estimated to be $87, 100.
III. Security to guarantee the payment of taxes as required
by Title 9 of the County Ordinance Code in the form of
a surety bond, No. B463031, issued by Reliance
Insurance Company with Dame' Construction Company,
Inc. , as principal , in the amount of $87 , 100
guaranteeing the payment of the estimated tax;
NOW THEREFORE BE IT RESOLVED that said subdivision, together
with the provisions for its design and improvement, is DETERMINED
to be consistent with the County's general and specific plans.
BE IT FURTHER RESOLVED that said Final Map is APPROVED and
this Board does not accept or reject on behalf of the public any
of the streets, paths, or easements shown thereon as dedicated to
public use.

BE IT FURTHER RESOLVED that said Subdivision Agreement is
also APPROVED.

SUBJECT: Approving Deferred Traffic Signal Fee Agreement for
Subdivision 7040, Danville Area. Assessor's Parcel
Nos. 220-070-002, 220-070-004 and 220-090-001.
The Public Works Director having reported that
Condition of Approval 23-C8 of Subdivision 7040 requires
execution of an agreement to pay for one-half of the cost of a
traffic signal at the intersection of Shadow Creek Drive and
Camino Tassajara.
The Public Works Director having recommended that he be
authorized to execute a Deferred Traffic Signal Fee Agreement
with Dame' Construction Company, Inc. , as required by the
Conditions of Approval for Subdivision 7040.
IT IS BY THE BOARD ORDERED that the recommendation of
the Public Works Director is APPROVED.

SUBJECT: Accept Cash Deposit to Guarantee Formation of Drainage
Area 1010A, Subdivision .7040, Danville Area.
The Public Works Director, having reported that the
conditions of approval for Subdivision 7040 requires the
developer, Dame' Construction Company, Inc. to participate in the
development of an Alamo Creek watershed protection plan and has
requested the Contra Costa County flood Control and Water
Conservation District to form Drainage Area 1010A to provide for
the maintenance of the on-site storm water detention basin.
Formation of the drainage area requires the consent of the
property owners of Subdivision 7040 which, prior to filing the
final map, is Dame' Construction Company, Inc.
The Public -Works Director having further reported that the
developer wishes to file the final map before the formation of
the drainage area which may jeopardize the outcome of the
election process in that consent from all the subsequent
homeowners would not be assured. To guarantee the perpetual
maintenance of the on-site detention basin, Contra Costa County
and Dame' Construction Company, Inc. agree to the following:
1. Dame ' Construction Company, Inc. has
deposited $255,000 cash (Auditor's Deposit
Permit No. 143302, dated July 19, 1988)
which is an amount that will provide for the
maintenance of the on-site detention basin.
2. Said $255, 000 cash deposit will be refunded
to Dame' Construction Company, Inc. , plus
interest, in accordance with Government Code
Section 53079, when this Board certifies
voter approval of the formation of Drainage
Area 1010A, which is anticipated to occur
within one month.
3. Contra Costa County will retain said $255, 000
cash deposit to be used to maintain the
detention basin in perpetuity if Dame'
- Construction Company, Inc. does not vote or
votes no during the election process of
Drainage Area 1010A formation.
The Public Works Director having .recommended that this Board
approve the above agreement between Dame' Construction Company,
Inc. and the County.
IT IS BY THE BOARD ORDERED that the recommendation of the
Public Works Director is APPROVED.
