ABSENT: None . _ ABSTAIN: None . ------------------------------------------------------------------=------ -------------------------------------------------------------------------- SUBJECT: Determination of Property Tax ) Exchange for Richmond-San Pablo ) RESOLUTION 88/ 573 Boundary Reorganization (LAFC 88-28) WHEREAS, Section 99 of the Revenue and Taxation ,code provides that affected cities and the County shall agree by resolution to exchange property tax revenues among themselves and any affected agencies in the event of a jurisdictional change; and WHEREAS, the Richmond-San Pablo Boundary Reorganization (LAFC 88-28) involves the transfer of service responsibility between the City of Richmond, the City of San Pablo and the West. County Fire Protection District affecting two separate parcels of land; and WHEREAS, Parcel 1 of the subject reorganization will be annexed to the City of Richmond and detached from the City of San Pablo and the West County Fire Protection District; and WHEREAS, Parcel 2 of the subject reorganization will be annexed to the City of San Pablo and West County Fire Protection District and detached from the City of Richmond. THEREFORE, BE IT BY THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY RESOLVED THAT, subject to the concurrence of the City of Richmond and the City of San Pablo, 1000 of the property tax accruing to the City of San Pablo and the West County Fire Protection District from Parcel 1 shall be transferred to the City of Richmond. In the case of Parcel 2, 1000 of the property tax accruing to the City of Richmond from said parcel shall be transferred to the City of San Pablo and the West County Fire Protection District and that the County Auditor-Controller shall allocate the tax transfer to the City and District as follows: City of San Pablo 47. 60 West County Fire Protection District 52. 4% The terms of the above tax transfers shall apply for the fiscal year for which the State Board of Equalization makes the tax rate area changes for this jurisdictional change. The terms of the transfers shall apply in subsequent years unless changed by the mutual agreement of affected agencies or subsequent jurisdictional changes. This Resolution does not change the property tax revenues accruing to other agencies serving the subject territory or the affected agencies ' right to collect taxes for existing bonded indebtedness. The property tax exchange agreement discussed above shall apply to affected territory as submitted or revised by the Local Agency Formation Commission.
