THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Resolution on August 9, 1988 by the following vote:

ABSTAIN: None RESOLUTION NO. 88/508
SUBJECT: Authorizing County Counsel to Initiate Action for
Completion of Improvements, Subdivisions MS 114-79 and
MS 275-78, Martinez Area. Work Order Nos. 5541 and
5538.
On August 21, 1984 this Board authorized the Public Works
Director to arrange for the completion of the subdivision
improvements required by Subdivisions MS 114-79 and 275-78,
pursuant to the subdivision agreement with Robert Gertz. The
surety company securing said agreements put up the bonding money
which was interpled with the court. The court turned over
administration of these funds to Mr. Gertz 's attorney who
arranged for the completion of the work which was done in the
early spring of 1987.
The Public Works Director having reported that the
improvements were not constructed per the approved plans and
therefore cannot recommend acceptance of the work as complete and
since no work has been done to correct the deficiencies or
complete the work per the approved plans, recommends that County
Counsel be authorized to initiate legal proceedings to insure the
improvements are completed in accordance with the subdivision
agreement.
NOW THEREFORE BE IT RESOLVED that County Counsel is
AUTHORIZED to initiate action to insure completion of
improvements and recover any costs in excess of the $2 , 000 cash
deposit (Auditor's Deposit Permit Nos. 39280, dated March 16,
1981 and 43694, dated August 11, 1981) from the developer, Robert
Gertz.
