RESOLUTION SPECIFIC REQUEST(S) OR RECOMMENDATION(S) S BACKGROUND AND JUSTIFICATION NO. 84Z784 The Board of Supervisors of Contra Costa County hereby resolves: In order to implement the Redevelopment Plan for the Pleasant Hill BART Station Project Area, Agency staff has presented the Agency with a proposed agreement for the Agency's purchase from Southern-Pacific Company of a portion of the abandoned right of way in the County and the Agency has requested that the County advance funds to provide for such purchase. The County anticipates purchasing from the Agency, a portion of the right of way the Agency purchases and anticipates that said purchase by the County will be 90% funded by a grant from the State of California, Department of Transportation. County staff has presented the Board with a proposed repayment con- tract with the Agency providing for the County to advance the sum of $1, 500,000 to the Agency for purchase of right of way and repayment of that advance from income the Agency derives from sale or lease of interests in the right of way acquired. It is anticipated that such advance would be repaid in full from the income the Agency derives from sale of a portion of the right of way to the County. The Agency's acquisition of the right of way and the County's advance to the Agency for such purposes will be of benefit to the Redevelopment Plan and will forward the health, safety and welfare of the County and its citizens. Therefore, the County Administrator or his designee is hereby author- ized to execute on behalf of the County a repayment agreement with the Contra Costa County Redevelopment Agency providing for the County to advance to the Agency an amount not to exceed $1,500,000 to be used to purchase abandoned railroad right of way in the County, for the advance to be repaid without interest out of proceeds of sales or leases of interests in the right of way purchased, and such other terms and conditions the County Administrator deems prudent and in the best interests of the County. The County Administrator or his designee is hereby authorized to take all actions and execute all documents necessary to carry out the County's obligations and rights under the repayment agreement approved above. The Board 'hereby appropriates the sum of $1,500,000 from the County General Fund for use in accordance with the repayment agreement approved above, and the County Administrator or his designee is authorized to expend such funds for such purpose.
