The Board of Supervisors of Contra Costa County RESOLVES
THAT:
On June 3, 1986 the voters of County Service. Area No. P-1
(Crockett) approved Ordinance No. 86-24 and the levying of an
annual special tax in CSA P-1 to provide increased funding for
recreation and park facilities and services . Government code
Section 50077 established the procedures for this 1986 election
for voter approval, by 2/3 vote, of a special property tax to
provide such additional funding. Ordinance No. 86-24 provides
for an annual non-ad valorem tax (not exceeding $57 ) to be levied
on each residential parcel in CSA P-1 and collected on the
County's secured roll.
On November 4, 1986 a statewide initiative measure
(Proposition 62) was approved which added § 53727 . to the
California Government Code. Subsection (b) of § 53727 provides
that any tax imposed by any local government (e.g. , CSA P-1) on
or after August 1, 1985, and prior to November 4, 1986 shall only
be continued after November 15, 1988 if prior to that date
(November 15, 1988) , the tax's continued imposition is approved
by a majority vote, of the involved electorate. For this reason,
the question of *continuing CSA P-1 ' s special tax after November
15, 1988 must be submitted to CSA P-1's voters . for majority
approval prior to that date.
This Board hereby calls an election on the attached P-1
Ballot Proposition (Exhibit A hereto) to be held on November 8,
1988 in the area of' CSA P-1 . This ballot must obtain approval by
a majority vote of the voters to be effective.
Further, this Board hereby orders that this election be
consolidated with the statewide general election on November 8,
1988 pursuant to Government Code § 53724(c) .
