Adopted this Resolution on August 23 , 1988 by the following vote:

ABSTAIN: Supervisor Powers* RESOLUTION NO. 88/546
SUBJECT: Approval of the Final Map and Subdivision Agreement for
Subdivision 6881, Pinole Area.
The Public Works Director having reported that Subdivision
6881 is currently in the process of being annexed into the City
of Pinole and the City has agreed to perform inspection `,of '.the
subdivision improvements in anticipation of annexation. The
City of Pinole will be issuing building permits for the homes in
this subdivision and collecting City permit fees which includes
an impact fee similar to our Area .of Benefit fee. The County has
collected Area of Benefit fees for this subdivision as a
requirement to filing the final map. There should not be a
duplication of fees from the County and City for the same
purpose.
The Public Works Director recommends that if said
subdivision is annexed and the City of Pinole collects an impact
fee for area-wide road improvements, that the County then refund
that amount from the Area of Benefit fee collected for this
subdivision back to the developer.
The following documents were presented for Board approval
this date:
The Final Map of Subdivision 6881, property located in the
Pinole area, said map having been certified by the proper
officials.
A Subdivision Agreement with Davidson, Kavanagh and Brezzo
Development Company, subdivider, whereby said subdivider agrees
to complete all improvements as required in said Subdivision
Agreement within one year from the date of said agreement.
Said documents were accompanied by:
I. Security to guarantee the completion of road
and drainage improvements as required by
Title 9 of the County Ordinance Code, as
follows:
A. Cash deposit (Auditor's Deposit
Permit No. 144156, dated August 8,
1988) in the amount of $3, 100 made
by Garrity Ridge-Joint Venture.
B. Additional security in the form of
a corporate surety bond dated
August 4, 19881 and issued by
Developers Insurance Company (Bond
No . 959857S ) with Davidson ,
Kavanagh and Brezzo Development
Company as principal, in the amount
of $ 307 , 400 for faithful
performance and $155,250 for labor
and materials.

II. Letter from the County Tax Collector stating that there
are no unpaid County taxes heretofore levied on the
property included in said map and that said property is
tax exempt;
NOW THEREFORE BE IT RESOLVED that said subdivision, together
with the provisions for its design and improvement, is DETERMINED
to be consistent with the County's general and specific plans.
BE IT FURTHER RESOLVED that said Final Map is APPROVED and
this Board does not accept or reject on behalf of the public any
of the streets, paths, or easements shown thereon as dedicated to
public use.
BE IT FURTHER RESOLVED that said Subdivision Agreement is
also APPROVED.
BE IT FURTHER RESOLVED that if Subdivision 6881 is annexed
to the City of Pinole and the City collects an impact fee for
area-wide road improvements, then the Public Works Director is
AUTHORIZED to refund to Garrity Ridge Joint Venture (Auditor' s
Deposit Permit No. 144156, dated August 8, 1988) that amount from
the Countywide Area of Benefit equal to the City fee but not to
exceed the amount originally collected, 'and to retain any
remaining fee to mitigate this subdivision's impact on County
roads.
