IN THE BOARD OF SUPERVISORS

CONTRA COSTA COUNTY, STATE OF CALIFORNIA
In the matter opposing )
Proposition 102 on the ) RESOLUTION NO. 88/ 535
November 8, 1988 Ballot )
WHEREAS, Acquired Immune Deficiency Syndrome (AIDS) has reached
epidemic proportions in California; and
WHEREAS, education has proved to be the most effective means of
stopping the spread of this deadly Acquired Immune Disease (AIDS) virus;
and
WHEREAS, voluntary testing of individuals in high risk groups is
widely encouraged by health professionals; and
.WHEREAS, confidentiality and personal anonymity are widely
recognized as essential components for encouraging at-risk individuals
to take the HIV test; and
WHEREAS, William Dannemeyer has qualified initiative No. 102 for
the November ballot, a measure that repeals confidentiality and
anonymity in testing for the HIV virus; and
WHEREAS, the Dannemeyer initiative would allow employers to make
unlimited use of the HIV antibody test (as regards hiring, firing,
etc. ) ; and
WHEREAS, the Dannemeyer initiative would repeal the current law
which does not allow insurance companies to use the* HIV antibody test;
and
WHEREAS, the Dannemeyer initiative would not allow alternative test
sites to do anonymous testing; and
WHEREAS, the Dannemeyer initiative would require that any doctor or
medical facility who has "reasonable cause to believe" that a person is
infected with "the probable causitive agent" of AIDS to report that
person's name to the local health officer within 48 hours. Anyone who
is told that he or she has "tested positive" would have to report
themselves within seven days. They would also be required to report the
names of anyone from whom the virus "may have been contracted" and to
whom the virus "may have been transmitted"; and
WHEREAS, the Dannemeyer initiative would require that test results
could be made available to all medical personnel involved in treating
the patient. Any possible sexual contacts may be notified; and
WHEREAS, the California Medical Association and the California
Nurses Association, the Public Health Officers Association and virtually
every responsible medical organization in California oppose the approach
behind Proposition 102;
NOW, THEREFORE, BE IT RESOLVED that the Contra Costa Board of
Supervisors hereby officially and formally opposes Proposition 102 and
urges all Contra Costa County residents to join in defeating this
initiative.
