RESOLUTION NO. 88/534 SUBJECT: In the matter of the Lesher ) General Plan Amendment. ) The Board of Supervisors of Contra Costa County RESOLVE: That there is filed with this Board and its Clerk, a copy of Resolution No. 33-1988, adopted by the County Planning Commission proposing an amendment to the County General Plan in the Concord/ Clyde area along Evora Road and proposing an amendment to the zon- ing for a portion of the Lesher parcel from General Agriculture (A-2) to Light Industrial (L-I ) . The Commission approval for the amendment calls for a change from General Open Space to Light In- dustry. On August 16, 1988, the Board held a hearing on said amendment. Notice of said hearing was duly given in a manner as required by law. The Board, at the hearing, called for testimony of all persons interested in this matter. The only person to testify on this matter was Norman L. Halverson of Bryan & Murphy Associates, representing Dean Lesher, speaking in favor of the amendment text and map. Mr. Halverson requested modification of the plan text to substitute the requirement for the processing of a development plan ­to be administratively reviewed by the Zoning Administrator in lieu of the requirement for processing of a land use permit. The Board asked staff about the acceptability of the proposed change. Staff responded by indicating that the proposed modifica- tion was acceptable. At the conclusion of the testimony, the Board closed the public hearing. Supervisor McPeak moved to approve the Lesher General Plan Amendment, rezoning File #2773-RZ in general accordance with the County Planning Commission recommendation and to accept the envir- onmental documentation. The motion further directed that the Development Guidelines Section of the Plan text be modified to read as follows: "IV. DEVELOPMENT GUIDELINES A. Development Processing: Development of projects within this area shall be processed through the Light Industrial District by submittal of a development plan to be administratively reviewed and approved by the Zoning Administrator. The Lesher parcel may be developed in phases; however, any tentative subdivision map application or development plan submittal shall include preliminary plans providing for the following items: r. ✓ y y RESOLUTION NO. 88/534 - anticipated grading storm drainage, sewage disposal and domestic water supply - preliminary landscape plans - access to the development - water reservoir elevation The development rights for a minimum of 20 acres designated as open space within the amendment area shall be conveyed to the County and/or other independent, land use trust in existence at time of development to serve as permanent open space. A water reservoir may be located within the designated open space area subject to approval of the water district and provision of access from the adjoining property (P.G.& E. ) to the east. " The revised plan text and map are attached hereto as Exhibit A. The Board hearby further finds that the proposed amendment and rezoning will have a significant impact on the environment and that an Environmental Impact Report was prepared and processed in compliance with the California Environmental Quality Act and the County' s Environmental Impact Guidelines. The Board further directs the Community Development Department to incorporate this amendment into a combined amendment to the General Plan which this Board will consider for adoption during the 1988 calendar year as one of the four permitted amendments to the mandatory elements of the County General Plan. cc: Community Development Department County Counsel County Administrator I hereby certify that this is a true and correct copy of County Public Works Dept. an action taken and entered on the minutes of the City of Concord Board of Supeors on the date shown.
