SUBJECT: BRENTWOOD ELECTION
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
BACKGROUND INFORMATION: The Board is aware of the problems with the Brentwood
election last November and we have formally requested certain follow-up on the matter.
Beyond this, however, certain questions and concerns need further attention.
The attached letter from the City of Brentwood refers to some of these concerns.
Specifically, everthing possible should be done to identify improper registered voters--
those who actually live outside the city and are using a business address or a relative's
address inside the city.
The other issue that deserves further follow-up is the whole question of legal
process for challenging a clearly faulted election system. Should the financial and legal
burden fall on a candidate when it is clear that the system failed as in this case with
improper addresses and registrations.
RECOMMENDED ACTION: Refer this matter to the County Administrator and the
Elections Department. I suggest we look at a proposal of legislation which would allow
this matter to be resolved in a judicial process without cost to any individual candidate
when it is determined by the Board of Supervisors or the Elections official that the issue
is one of a faulty system.
