See. 1245.230) 5 6 The Board of Supervisors of Contra Costa County, California, 7 by vote of two-thirds or more of its members, RESOLVES that: 8 Pursuant to Government Code Section 25350.5 , Contra Costa 9 County intends to construct a public improvement , namely, the West 10 County Justice Center and, in connection therewith, acquire 11 interests in certain real property. 12 The property to be acquired consists of two (2) parcels and is 13 generally located in the Richmond area near Giant Road and Atlas . 14 Road. Said property is more particularly described in Appendix 15 "A", attached hereto and incorporated herein by reference. 16 Certain of the property is to be acquired for a more necessary 17 public use pursuant to Code of Civil Procedure S 1240.610, or for . 18 a compatible public use pursuant to Code of Civil Procedure 19 1240.510. 20 On July 7 , 1987 , this Board passed a Resolution of Intention 21 to adopt a Resolution of Necessity for the acquisition by eminent 22 domain of the property described in Appendix "A" (Resolution No. 23 87/407) and fixing July 28 , 1987, in its Chambers in the 24 Administration Building, 651 Pine Street , Martinez, California, as 25 the time and place for the hearing thereon. 26 Notice of the hearing was duly given, the hearing was held at 27 that time and place, and all interested parties were given an 28 opportunity to be heard. Based upon the evidence presented to it, RESOLUTION NO. 87/464 t- t' 1 this Board finds , determines and hereby declares the following: 2 1 . The public interest and necessity require the proposed 3 project; and 4 2. The proposed project is planned and located in the manner 5 which will be most compatible with the greatest public good and 6 the least private injury; and 7 3. The property described herein is necessary for the pro- 8 posed project; and 9 4. The offer required by Section 7267.2 of the Government 10 Code was made to the owner or owners of record. 11 The County Counsel of this County and any special counsel 12 associated by him is hereby AUTHORIZED and EMPOWERED: 13 To acquire in the County's name, by condemnation, the titles,. 14 easements and rights of way hereinafter described in Appendix A, 15 in and to said real property or interests therein, in accordance 16 with the provisions for eminent domain in the Code of Civil 17 Procedure and the Constitution of California: Parcel 1 is to be 18 acquired in fee, Parcel lA is to be acquired as a temporary 19 construction easement; 20 To prepare and prosecute in the County's name such proceedings 21 in the proper court as are necessary for such acquisition; and 22 To deposit the probable amount of compensation, based on an 23 appraisal , and to apply to said court for an order permitting the 24 County to take immediate possession and use said real property 25 for said public uses and purposes. 26 PASSED and ADOPTED on July 28, .1987, by the following vote: 27 AYES: Powers, Fanden, Schroder, Torlakson and McPeak 28 -2- 7 Y 1 NOES: None 2 ABSENT: None '3 ABSTAIN: None 4 I HEREBY CERTIFY that the foregoing resolution was duly and 5 regularly introduced, passed and adopted by the vote of two-thirds 6 or more of the Board of Supervisors of Contra Costa County, 7 California, at a meeting of said Board on the date indicated. 8 Dated: July 28, 1987 Phil Batchelor, Clerk of the 9 Board of Supervisors and County Administrator 10 11 By: .
