Res. C. Section 26653) Ordering Levy and Collection ) Thereof ) The Board of Directors of the Canyon Lakes Geologic Hazard Abatement District RESOLVES that: On June 4, 1985, the County Board of Supervisors adopted Resolution No. 85/289, approving the formation of a geologic hazard abatement district (GHAD) for the Canyon Lakes area and appointing the Board of Supervisors as the initial Board of Directors for the GHAD. On July 15, 1986, the Board of Directors of the Canyon Lakes GHAD adopted Resolution No. 86/407, approving the GHAD budget for the 1986-1987 - fiscal year and approving the GHAD Repair, Maintenance and Improvement Program. On July 15, 1986, the Board of Directors of the Canyon Lakes GHAD adopted Resolution No. 86/409, declaring the Board's intention to order that the costs and expenses of maintaining and operating the, GHAD improvements shall be assessed against the property within the District. Said Resolution further declared the Board's intention to assess against the property within the District, for the 1986-1987 fiscal year and for subsequent fiscal years, all or part of those amounts set forth in the Report prepared by the General Manager of the GHAD pursuant to Pub. Res. C. Section 26651 , which Report is attached as Exhibit A to said Resolution. Said Resolution further fixed July 29 , 1986 at 10: 30 a.m. as the time for the hearing of any protests to the proposed assessments, and further directed the Clerk of the Board to mail notice of said hearing pursuant to Pub. Res. C. Section 26652 . NOW, THEREFORE, THE BOARD OF DIRECTORS HEREBY RESOLVES, FINDS, CERTIFIES AND ORDERS AS FOLLOWS: 1 . A public hearing before this Board for the hearing of any protests to the proposed assessments within the Canyon Lakes GHAD was held on July 29, 1986 at 10: 30 a.m. Notice of said hearing was given in accordance with the provisions of Pub. Res . C. Section 26652 . 2. At the hearing, the Board heard and considered any and all protests to the proposed assessments . Thereafter, the Board closed the hearing. 3. The Board hereby ORDERS that the costs and expenses of maintaining and operating the GHAD improvements shall be assessed against all property within the District. RESOLUTION NO. 86/447 t • 4 . The Board further CONFIRMS the assessments, as set forth in the above-referenced General Manager 's Report, and ORDERS that the amount of. said assessments against each parcel of property within the District shall be in accordance with the following rates: Per unit rate (base rate for 1986-1987 fiscal year ) based upon type of use as follows: Single Family Detached 101 .22 per unit per annum Townhouses 67.80 per unit per annum Condominiums/Rentals 50 .62 per unit per annum Commercial 0.05 per square foot per annum The foregoing rates shall be adjusted July 1 of each fiscal year to reflect the increase, if any, from July 1 of the prior fiscal year, in the Consumer Price Index for All Urban Consumers, All Items, San Francisco-Oakland Metropolitan Area (1967=100) published by the United States Department of Labor, Bureau of Labor Statistics, or its successor index. 5 . The Board further ORDERS that the amounts set forth above shall be assessed against the property within the District for the 1986-1987 fiscal year and for subsequent fiscal years. 6. The Board further ORDERS that said assessments shall be levied and collected in the following manner : , (a) The Clerk of the Board shall cause to be recorded a notice of assessment, as provided for in Section 3114 of the California Streets and Highways Code, whereupon the assessment shall attach as a lien upon the property, as provided in Section 3115 of the Streets and Highways Code. (b) Thereafter , said assessments shall be payable at the same time and in the same manner as general taxes on real property within the District are payable . (c) All funds generated by said assessments, and all interest earned thereon, shall be segregated and deposited in a separate account for the exclusive benefit of the Canyon Lakes GHAD, and shall not be deemed at any time to constitute funds credited to the County treasury. 1 hereby certify that this Is a true rind correct copy of an action taken and entered on the minutes of the Board of Supervisors on the date shown.
