SUBJECT: Declaring Intent to Detach Zone 5, Paso Nogal (Subdivision
5735) , from Assessment District No. 1974-3 (LL-2) and Refund
Balance of Assessments Collected, Pleasant Hill Area.
The Board of Supervisors of the County of Contra Costa resolves:
The Board of Supervisors declares its intention to detach 7.one 5,
Paso Nogai , Subdivision 5735, from Contra Costa County Landscape and
Lighting Maintenance District No. 1979-3 (LL-2) and to refund the balance
of assessments collected from 45 property owners to the present owners of
the properties.
Zone 5 was annexed to Assessment District No. 1479-3 (LL-2) on
November 27, 1984 by Board Resolution No. 84/702. The resolution required
that the zone be included in the levy of an annual assessment for the
maintenance of landscaping in fiscal year 1985-86.
By Board Resolution No. 85/452, dated July 30, 1985, an assessment of
$166.68 was levied on each of 45 properties in Zone 5 for anticipated
maintenance during fiscal year 1985-86.
Contrary to anticipation the developer of the subdivision did not
satisfactorily complete installation of the landscaping until May 1986.
By this time the subdivision had been annexed to the City of Pleasant
Hill . The developer has agreed with the city to maintain the landscaping
until May 1987 at which time the City will be responsible.
There being no further reason for the County to be involved it is
desirable to detach the subdivision from the county assessment district
and refund the remaining monies collected.
At 10:30 a.m. on Tuesday, August 26, 1986 in the Chambers of the
Board of Supervisors of the County of Contra Costa, Administration Building,
65.1 Pine Street, Martinez, California 94553, the Board of Supervisors will
conduct a public hearing on the proposed detachment and refunding of
assessments. Any interested person, prior to the conclusion of the
hearing, may file a written protest with the Clerk of the Board. A
written protest shall state all grounds for objections. A protest by a
property owner shall contain a description sufficient to identify the
property owned by him.
The Clerk of the Board shall provide Notice of Hearing by publication
of this Resolution once a week for two successive weeks according to
Section 6066 of the Government Code, the first publication at least
fifteen days before the hearing.
