Exchange for the H-M Detachment) SOLUTION NO. 84/ 517
From the City of Walnut Creek )
(LAFC 84-31) )
WHEREAS, Section 99 of the Revenue and .Taxation -Code provides
that the City and the County shall agree by resolution to exchange
property tax revenues among themselves and any affected agencies; and
WHEREAS, the H-M Detachment from the City of Walnut Creek
(LAFC 84-31) involves detachment from the City of Walnut Creek and
concurrent annexation to County Service Area P-6 ; and
WHEREAS, the affected territory of the subject detachment was
recently annexed to the City of Walnut Creek by operation of the Arlene
Gardens Annexation to the City of Walnut Creek (LAFC 83-20) . Property
tax transfer for said annexation was in accordance with the Master
Property Tax Transfer Agreement between the City and the County; and
WHEREAS, it is proposed that the property tax revenue that
would have accrued to the City of Walnut Creek from the affected ter-
ritory of the subject detachment as a result of the Arlene Gardens
Annexation to the" City of Walnut Creek (LAFC 83-20) shall, revert back
to the County and that there be no transfer of property tax to County
Service Area P-6 as a result of the subject. detachment;
THEREFORE, BE IT BY THE BOARD OF SUPERVISORS OF CONTRA COSTA
- COUNTY RESOLVED that in accordance with Section. 99 of the Revenue and
Taxation Code the property tax increment allocation factors for the
affected agencies in the area of the H-M Detachment from the City of
Walnut Creek. (LAFC 84-31) shall be the same as existed prior to the
Arlene . Gardens Annexation to the City of Walnut Creek (83-20) and
that there be no transfer of property tax to County' Service Area P-6
as a result of the subject jurisdictional changes. Said increment
tax allocation factors apply to affected territory as submitted or
revised by the Local Agency Formation Commission. This resolution
does not change the property tax revenues accruing to other agencies
serving the subject territory or the affected districts' right to col-
lect taxes for existing bonded indebtedness.
