Sec. 8334) The Board of Supervisors of Contra Costa County RESOLVES THAT: This vacation request was made by two adjacent property owners as a single request under the Street and Highway Code Section 8334(a) and is for the vacation of the County's interest in a surplus Offer of Dedication shown on Parcels "B" and "C" of Minor Subdivision 100-68 filed in Book 4 of Parcel Maps at page 49 and located in the Oakley area. For a description of the portion to be vacated, see Exhibit "A" attached hereto and incorporated herein by this reference. On July 10, 1984 the Contra Costa County Planning Commission found the project in conformance with the existing General Plan. This Board hereby FINDS that the proposed vacation will not have a significant effect on the environment, and that it has been determined to be categorically exempt under State guidelines' Section 15312 in compliance with the California Environmental Quality Act, Class 12 Categorical Exemption. The property does not have significant values for wildlife habitat or other environmental purposes, and the use of the property and adjacent property has not changed since the time of filing the Parcel Map. The Planning Department having filed its general plan report concerning this proposed vacation and this Board having considered the general plan, it finds pursuant to Government Code Section 65042(a) that the project site is shown as "Single Family Residential Low-Density" in the East County Area General Plan and that it has received the Planning Commission's report. This Board declares that the hereinabove described proposed vacation area is HEREBY ORDERED VACATED subject to any reservation and exception described in attached Exhibit "A": From and after the date this Resolution is recorded, the portion vacated no longer constitutes a highway. This vacation is made under the Streets and Highways Code, Chapter 4, Sections 8330 et seq, which allows the summary vacation of lands when: 1) And excess right of way of a street or highway is not required for street or highway purposes; or 2) A portion of a street or highway lies within property under one ownership and does not continue through such ownership or end-touching property of another. 00007
