Super-visors -Powers , F-anden, Schroder, McPeak, Torlakson . NOES: None ABSENT: None RESOLUTION NO. 84/ 501 (Gov. Code Sec. 25526.5) SUBJECT: Approving Agreement with Jones Development Company, Convey Real Property and Approve Drainage Release Pinole Animal Shelter Project No. 3340-2310 (Work Order 5537) The Board of Supervisors of Contra Costa County RESOLVES that: The County of Contra Costa presently owns and operates an animal control facility at 790 San Pablo Avenue, Pinole. The City of Pinole has recently approved a residential development plan submitted by the Jones Development Company for property northerly and westerly of the County property. Said plan provides for the construction of a City street that will improve the access to the County property. In order to facilitate this project, the County and Jones Development Company have prepared a tentative agreement which provides, among other things, the following: e 1. Jones 'Development Company. is to construct a masonry fence around the County parcel and relocate the access from the easterly to the westerly property line. 2. Jones Development Company is to provide the County with a drainage release over their adjacent parcel . 3. County is to deed to Sugar City Building Materials Company, the adjacent easterly owner, the easterly 60 feet of the County property. Said property is totally encumbered with access easements for other owners in the area. Upon recommendation of the Public Works Director, this Board hereby APPROVES the Property Transfer and Improvement Agreement with Jones Development Company and AUTHORIZES its Chairman to sign said Agreement on behalf of the County. The Board further FINDS that the real property described in Exhibit "A" attached hereto, is no longer needed or necessary for County or other public use and that its value does not exceed $10,000. Therefor, pursuant to Government Code Section 25526.5 the Board Chairman is AUTHORIZED to sign on behalf of the County a Grant Deed to Sugar City Building Materials for said property. The Drainage Release dated July 2, 1984, from Jones Development Company is hereby approved and the Board Chairman is AUTHORIZED to sign said Release on behalf of the County. The Real Property Division of the Public Works Department is DIRECTED to cause the Grant Deed and a certified copy of this Resolution to be delivered to the grantee. The Board further DETERMINES that the conveyance of the County owned real property is considered a Class 12 Categorical Exemption (disposal of surplus government property) from environmental impact report requirements and DIRECTS the Public Works Director to file a Notice of Exemption with the County Clerk. The City of Pinole has found the project in conformance with its General Plan. Orig.
