NOES: None. ABSENT: None . ABSTAIN: None. SUBJECT: Determination of Property Tax ) Transfer for Annexation No. 261) RESOLUTION N0. 84/459 to West Contra Costa Sanitary ) District (LAFC 84-26 ) ) WHEREAS, Section 99.1 of the Revenue and Taxation Code provides that a jurisdictional change resulting from a special district providing one or more services to an area where such services have not been pre- viously provided shall not become effective if one or more affected special districts involved in the property tax exchange negotiation fails to adopt a resolution agreeing to a transfer; and WHEREAS, the Board of Supervisors shall determine the property . tax exchange for each affected district that fails to adopt a resolution agreeing to a property tax transfer except for the annexing district; and WHEREAS, Annexation No. 261 to West Contra Costa Sanitary District . (WCCSD) (LAFC 84-26) proposes annexation of territory which results in provision of services not previously provided and no resolutions have been adopted agreeing to property tax exchanges; and WHEREAS, in the absence of a master agreement for property tax exchange between the County and WCCSD, the County and WCCSD have agreed that the property tax exchange agreement for this annexation will be in accordance with the terms of the existing master agreement between the County and the Central Contra Costa Sanitary District and the East Bay Municipal Utility District. THEREFORE, BE IT BY THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY RESOLVED that the property tax increment allocation factors for the affected agencies in the area of Annexation No. 261 to the West Contra Costa Sanitary District (LAFC -84-26) for the 1985-1986 fiscal year and subsequent years shall be in accordance with the terms of the above master agreement between the County and the Central Contra Costa Sanitary District and the East Bay Municipal Utility District, , said increment tax allocation factors apply to affected territory as submitted or revised by the Local Agency Formation Commission. SUBJECT: Determination of Property Tax) Exchange for North Gate I ) Boundary Reorganization ) RESOLUTION No. 84/45$ (LAFC 84-17) , ) WHEREAS, Section 9.9 of the Revenue and Taxation Code provides that the City and the County shall agree by resolution to exchange property tax revenues among themselves and any affected agencies; and WHEREAS, the North Gate I Boundary Reorganization (LAFC 84-17) involves annexation of territory to the City of Walnut Creek for which property tax exchange is determined by the previously approved Master Property Tax Exchange agreement; and WHEREAS, the Reorganization proposes concurrent annexation to Central Contra Costa Sanitary District for which property tax exchange is determined by the previously approved Master Property Tax Exchange agree- ment; and WHEREAS, for the property tax allocation to be made under this resolution the Auditor-Controller of Contra Costa County shall first apply the provisions of the Master Property Tax Agreement between the City of Walnut Creek and the County and then apply the provisions of the Master Property Tax agreement between the Central Contra Costa Sanitary District and the County; THEREFORE, BE IT BY THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY RESOLVED that in accordance with Section 99 of the Revenue and Taxation Code the property tax increment allocation factors for the affected agencies in the area of the North Gate I Boundary Reorganization (LAFC 84-17) for the 1985-1986 fiscal year and subsequent years shall be in accordance with the Master Property Tax agreements mentioned above. Said increment tax allocation factors apply to affected territory as submitted or revised by the Local Agency Formation Commission.
