(Excluding Retirement General Counsel-Exempt from the merit system)
The Contra Costa County Board of Supervisors ordains as follows (omitting the parenthetical
footnotes from the official text of the enacted or amended provisions of the County Ordinance Code):
SECTION 1: Section 33-5.393 of the County Ordinance.Code is amended to exclude from the merit
system the additional classification of retirement general counsel-exempt, to read:
33-5.311 Retirement administrator.
(a) The retirement administrator is exempt and is appointed by the board of retirement of the
Contra Costa County Employees' Retirement Association.
(b) The assistant retirement administrator-exempt is exempt and is appointed by the retirement
administrator.
(c) The retirement chief investment officer-exempt is exempt and is appointed by the
retirement administrator.
(d) The retirement general.counsel-exempt is exempt and is appointed by the retirement

SECTION II: EFFECTIVE DATE. This ordinance becomes effective 30 days after passage, and
within 15 days of passage shall be published once with the names of the supervisors voting for and
against it in the , a newspaper published in this County.

Retirement Chief Executive Officer-Exempt. This classification will require numerous hours in the public view
representing the Retirement Association and providing legal counsel for the Retirement Association Board.They will
additionally be required to provide program direction and fashion short-term and long-term legal service plans,while
also conferring with the Retirement Chief Executive Officer to guide policy. Thus, given the high executive level of
legal background required for this position as well as the excessive public presence required of this classification, it
would be impractical to recruit and test under the traditional merit system procedures.
CONSEQUENCE OF NEGATIVE ACTION:
If this request is not approved, the classification of Retirement General Counsel will not be able to perform
confidential specialized duties for the Contra Costa County Employees' Retirement Association. Furthermore,the
department's flexibility in filling this highly important position will be significantly compromised.
