The Contra Costa County Board of Supervisors ordains as follows:
SECTION 1: Page G-13 of the County's 1978 Zoning Map(Ord.No.78-93)is amended by
re-zoning the land in the above area shown shaded on the map(s)attached hereto and incorporated
herein(see also Community Development Department File No. RZO13100 .)
FROM: LandUseDistrict M-29 (_ Multiple Family Residential )
TO: LandUseDistrict C ( General Commercial )
and the Community Development Director shall change the Zoning Map accordingly,
pursuant to Ordinance Code Sec.84.2.003.

SECTION II. EFFECTIVE DATE. This ordinance becomes effective 30 days after passage,
and within 15 days of passage shall be published once with the names of supervisors

published in this County.

RECOMMENDATIONS
1. ADOPT the recommendation of the County Planning Commission, as contained in their
Resolution No. 11-2001, to approve the rezoning of the 10,890 sq. ft. property from
Multi-family Residential District (NI-29) to General Commercial (C).
2. ADOPT the findings contained in the County Planning Commission Resolution No. 11-
2001 as the basis for the Board's action.
�. FIND the Negative Declaration prepared for this project to be adequate for the purposes
of compliance with the California E=nvironmental Quality Act, and adopt the same.

4. INTRODUCE the ordinance giving effect to the aforesaid rezoning, waive
reading and set date for adoption of same.
5. DIRECT the Community Development Department to post the Notice of
Determination with the County Clerk.
FISCAL IMPACT: The applicant is responsible for cost of processing the
application.
BACKGROUND/REASONS FOR RECOMMENDATIONS
The applicant is requesting the rezoning of the 10,890 sq. ft. property from Multi-family
Residential District (M-29) to General Commercial (C) to establish consistency with the
General Plan Commercial (CO) designation.
The zoning districts in the surrounding area consist of RB (Retail Business) to
the south and west; C (General Commercial) to the north and east. The uses in the
immediate area consist predominantly of Commercial buildings.
The applicant's request was heard by the County Planning Commission on June 12, 2001.
The County Planning Commission, after evaluating the proposal and evidence submitted,
voted to recommend approval of the proposed rezoning to the Board of Supervisors:
The Department received a letter regarding this project from Debra L. Williams who owns a
business on 5011 Blum Road, which addressed some concerns about the existing traffic
congestion on Blum Road. Mrs. Williams has requested that current traffic patterns,
parking, site safety, and other issues be considered before the rezoning of the property is
approved. Staff has contacted Mrs. Williams and stated that the applicant had not
submitted any development plan as part of the rezoning proposal and that before any
development plan occurs on the subject site, the applicant will have to obtain approval from
the County and secure a development plan/ land use permit. The adopted Contra Costa
County General Plan EIR (Environmental Impact Report) did not identify any significant
traffic impact due to the fact that the General Plan Designation of the site is commercial.
Staff is relying on the adopted EIR to conclude that a commercial project would not cause a
significant traffic impact; however, the potential for a traffic impact on Blum Road would also
be analyzed at the time a development plan/land use permit is submitted. Additionally, Mrs.
Williams was informed that even though her letter was not presented at the June 12, 2001,
Planning Commission meeting, her letter would be attached to the Board of Supervisors
package and that she would be informed of the July 24, 2001 public hearing.
