Uncontrolled Burning in the Delta Area
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) 8i BACK.GROUND AND JUSTIFICATION
RECOMMENDATION:
Acknowledge receipt of the report from the County Administrator
on the subject of uncontrolled burning in the Delta Area in
response to the Board' s referral of. April 28, 1987 .
BACKGROUND:
On April 28, 1987, the Board of Supervisors referred to the
County Administrator a request initiated by Supervisor Torlakson
requesting that the Fish and Wildlife Study Committee, Fire
Chiefs Association, Health Services Department, and Bay Area Air
Quality Management District comment on the subject of
uncontrolled burning in the Delta in terms of air pollution or
health problems. Each of the agencies has had the opportunity to
comment on this subject. The following .conclusions summarize the
responses of the various agencies:
1 . The Bay Area Air Quality Management District has very
specific and detailed regulations which control open
burning. This regulation (Regulation 5) and a cover memo
from the Health Services Director are attached as Attachment
#1 to this report.
2. The Riverview Fire Protection District issues burn permits
throughout both its district and the east county volunteer
districts consistent with the BAAQMD' s Regulation 45. Of
the two incidents cited by Supervisor Torlakson, one
involved a controlled burn on Winter Island for which a
permit had been obtained from the Riverview Fire Protection
District. At the same time, there were several fires across
the river in Solano County, outside the jurisdiction of the
Riverview Fire Protection District. The other incident also
occurred in Solano County and was either accidentally or
purposely set without a permit. Chief Little' s letter and a
copy of Riverview' s Burn Permit are attached as Attachment
#2.

Richard Costa has obtained the procedures which are followed
by the Suisun Fire Protection District in issuing a burn
permit to duck clubs or property owners. These procedures
are consistent with the BAAQMD' s Regulation #5 . A copy of
Inspector Costa' s memorandum is attached as Attachment #3 .
4 . The Fish and Wildlife Study Committee recommends that
controlled burning of wetland/marsh habitat be allowed to
continue as an acceptable method of managing marshes and
wetlands. The Committee deferred to the fire district on
the question of whether uncontrolled burning should be
contained once ignited either accidentally or purposely.
David Okita' s memorandum on behalf of the Committee is
attached as Attachment #4.
From these responses, we can conclude that controlled burning is
an appropriate method of managing wetlands and marshes when it is
done with a burn permit, and when the conditions of the permit
and the rules of the BAAQMD are followed.
Chief Little comments in Attachment #2 on the difficulty of
extinguishing a tulle fire which may be ignited either
accidentally or purposely, but without a burn permit. Whether in
the instances cited by Supervisor Torlakson the Suisun Fire
Protection District "allowed" the fires to continue to burn, or
was unable to put them out, is a question which has not been
answered. If the Board wishes to pursue this issue further, we
would recommend that the Board direct the County Administrator to
place this matter on the agenda for the next meeting with the
Solana County Board of Supervisors and ask them to look into
these two instances and more generally to comment on the policy
of the Suisun Fire Protection District on the issue of whether
they attempt to extinguish tulle fires, such as apparently caused
the problems cited by Supervisor Torlakson.

In response to your June 29, 1987 request, staff has contacted the BAAQMD
regarding controlled burning in the Delta area. We were informed that
Regulation 5, a copy of which is attached, pertains to open burning. The regu-
lation generally prohibits open fires, with the exception of those fires speci-
fically exempted, subject to conditions imposed by the regulation.
It is our opinion that fire safety is more significant than any potential health
threats that airborne emissions from uncontrolled burning might present. We
would therefore defer to the fire agencies a decision as to whether containment
of an uncontrolled fire is necessary or not.

OPEN BURNING
5-100 GENERAL
5-101 Description:This Regulation forbids open burning within the District with certain
exemptions.
5-110 Exemptions: The following fires are exempt from this Regulation:
110.1 Fires used only for cooking of food for human beings. Fires used for
recreational purposes using only clean dry wood or charcoal, and a small
amount of firestarter.
110.2 Fires burning as safety flares or for the combustion of waste gases.
110.3 The use of flame cultivation when the burning is performed with LPG or
natural gas-fired burners designed and used to kill seedling grass and
weeds in orchards, vineyards and field crops and the growth is such that _
the combustion will not continue without the burner.
110.4 Any fire, if it can be demonstrated that nothing but carbon dioxide,. ,
nitrogen oxides, or water vapor is emitted under all operating conditions.
110.5 Fires set for the purposes of fire training using a gallon or. less .of ..
flammable liquid.
5-111 Conditional Exemptions: The following special conditions must be met for fires
allowed by Sections 401.1 through 401.13 unless specifically exempted in that
Section, and shall be complied with during any burning permitted under those
Sections.
111.1 No burning before 8:00 a.m., local time.
111.2 No additional materials or fuel shall be ignited nor shall any material or
fuels be added to any fire after two hours before sunset.
111 .3 No material or fuel shall be ignited, nor shall any material or fuel be added
to any fire when the wind velocity is less than five (5) miles per hour, or
when the wind direction at the site shall be such that the direction of
smoke drift shall be other than away from populated areas in order to
minimize local. nuisances causedr by smoke .and particulate fallouts.
111 .4 All piled material shall have dried fora minimum of 60 days prior to ignition
or shall have been demonstrated to contain less than 23% moisture by
weight..
111.5 Material to be burned shall not contain more than 5$, native soil on a
weight basis.
111.6• Piled material shall be limited to a base area not to exceed 25 square
yards and the height shall beat least 2/3 of the average width of the pile.
111 .7 Ignition material shall be limited to those listed by the State Director of
Forestry, as follows: orchard torches; drip torches; pressurized diesel
torches; propane or LPG torches; commercial petroleum gel materials,
pressurized or solid (napalm or blivets); commercial safety fuses;
commercial type ignition grenades, e.g. Fenner, etc.; fuses; commercial
fuse lighters and matches. All fires shall be ignited so as to burn as
rapidly as possible within conditions of safety and minimum pollution.
111.8 Ignition shall be initiated at or near the top of the piled material. No
additional material, except ignition material, shall be added to the fire.
111 .9 Tonnage of material burned on anygiven day and/orat any specified site is
subject to limitations set by the AP CO, but may not exceed any limits set
by the ARB.
5-200 DEFINITIONS
` 5-201 Agricultural Fire: A fire used for the purpose of initiating, continuing or
`. maintaining agriculture as a gainful occupation. Fuels are limited_to materials
grown on the site and not to include.feed or fertilizer containers, finished lumber-,

plastic or rubber products, plumage, hides, fur, offal or fecal material or refuse
from plant or animal processing other than from initial crop harvesting, pruning or
attrition of forest, fruit and nut trees, vines and cane crops.
5-202 Fire: Any combustion of combustible materials of any type outdoors in the open,
not in any enclosure, where the products of combustion are not directed through a
flue.
5-203 Flue: Any duct or passages for air, gases, or the like, such as a stack orchimney.
5-204 Gainful Occupation: Any occupation from which there is proof of gross profit or
loss as evidenced by tax receipts, sales slips or other such documents.
5-205 Notification: The verbal or documentary notification.of intent to use open fire
under the provisions of this Regulation. If verbal notice is given, there must be
at written confirmation of this action sent to the .AP CO within 5 days.
5-206 Permissive Burn Day: Any day that is so declared by the APCO when, in his opinion,
air pollution caused by open burning may be minimized. In declaring such
permissive burn days, the meteorological criteria established by the ARB for the
San Francisco Bay Area Basin shall be used as a guideline.
5-207 Treated Brush: Material which as been felled, crushed or uprooted with
mechanical equipment, or has been desiccated with herbicide.
5-208 Hazardous Material, Combustible:For purposes of this Regulation; material which
may pose a fire or explosive hazard but-not including any material which has a
threshold level value as set by the American Conference of Governmental
Industrial Hygienists. (Adopted Match 179 1982)
5-300 STANDARDS
5-301 Prohibition of Fires: A person shall not ignite, cause to be ignited, permit to be
ignited, or suffer, allow, or maintain any fired within the District, except as
provided in this Regulation. No burning shall take place within the District on
other than a permissive burn day.
5-400 ADMINISTRATIVE REQUIREMENTS
5-401 Allowable: Fires: The following fires may be allowed on permissive burn days:
401. 1 Disease and Pest: Fires for the purpose of disease and pest prevention.
The fires must beset or allowed by the Agricultural Commissioner of the
County in-the performance of official duty. Prior notification must be
made to the- APCO.
401 .2 Crop Replacement: Agricultural fires for the purpose of establishing an
agricultural crop in a location which formerly contained another type of
agricultural crop or natural growth. The fires must be set or allowed by
the public officer having jurisdiction, in the performance of official duty,
and must be necessary for the crop replacement to proceed. Fires are
limited to a period beginning October 1 and ending April 30; however, upon
the determination of the APCO that heavy winter rainfall has prevented
such burning, the burn period shall be extended until June 30.
401 .3 Orchard Pruning and Attrition: Agricultural fires for the purpose of
disposal of periodic prunings and attrition losses from fruit trees, nut
trees, vineyards and cane fruits. Fires must be set or allowed by the
public officer having jurisdiction, in the performance of official duty, and
must be necessary to maintain and continue the growing of the fruit
trees, vineyards and cane fruits as a gainful occupation. Fires are
limited to a period beginning November 1 and ending April 30; however,
upon the determination of the APCO that heavy winter rainfall has
prevented such burining, the burn period shall be extended until June 30.

401 .4 Double Cropping Stubble: Agricultural fires for the purpose of disposal of
grain stubble from agricultural land from which both grain and vegetable f
crops are harvested during the same calendar year. Fires must be set or
allowed by a fire official having jurisdiction, in the performance of official

duty, and must be necessary to remove the grain stubble and straw before a
field vegetable crop can be planted. Fires are limited to a period
beginning June 1 and ending August 31.
401.5 Stubble: Agricultural fires for the purpose of disposal of stubble and straw.
-`' Fires must be set or allowed by a fire official having jurisdiction, in the
performance of official duty, and must be necessary to maintain and
continue the growing of field crops as a gainful occupation. Fires are
limited to a period beginning September 1 and ending December 31.
401 .6 Hazardous Material: Any fires for the purpose of the prevention of a fire
hazard, including the disposal of dangerous materials. The fires must be
sat or allowed by any public officer, in the performance of official duty.
The fires must, in the opinion of such officer, be necessary, and the hazard
notable to be abated by any other means. prior notification must be made
to the AP CO.
401.7 Fire Training: Fires for the purpose of instruction of either public or
industrial amployess in fire fighting methods. The fires must be set or
allowed by the public officer having jurisdiction, and must be, In his
opinion, necessary. Notwithstanding contrary provisions of Section 5-
111, a fire fighting agency may set one firs per .quarter year for the
purpose of training volunteer fire fighters. This may be done on other
than a permissive burn day if the APCO is notified at lust two weeks in
advance. Prior notification must also be made-to the APCO for other fire
training.
401.8 Flood Debrist Fires for the purpose of removing wood and vegetation debris
deposited by flood waters. The fires must be sat or allowed by the public
officer having jurlsdictlor4 in the performance of official duty,and must be
necessary for the continuing or maintaining of agriculture as a gainful
occupation. Fires are limited to a period beginning October 1 and ending
- May 31.
401°.9" Irrigation Ditches: Fire for the purpose of controlling growth of
" vegetation in irrigation ditches and canals. The fires must be set or
allowed by a fire official having jurisdiction, in the performance of official
duty, and must, in the opinion of such officer, be necessary. Prior
notification must be made to the APCO.
401.10 Flood Controls Fires for the purpose of disposal of material which is lying or
growing within natural channelsorflood control channels.. The fires must
be sat or allowed by a public official in charge of flood control activities.
The fire must,in the opinion of such offielal,be a necessary incident to the
clearing and maintenance of water courses and flood control channels for
preventing or ollminating s flood hazard. Prior notification must be made
to-the APCO.
401'.11 Range Managements Fires for the purpose of range management and
grazing. The fires must be set or allowed by 'the State Director of
Forestry, or fire official, and must be necessary to maintain and continue
the grazing of animals as a gainful occupation. Brush to be burned shall be
treated at lust six months prior to burn if determined to be technically
feasible by the Stats Director of Forestry orfIre official. Unwanted trees
over 6 inches in diameter shall be felled prior to burn and dried for a
minimum of six months. Feasibility shall be subject to the approval of the
APCO. Sections 5-111.1 and 5-111.6 may be waived by the State
Director of Forestry or fire official when determined necessary in the
public interest. Fires are limited to a period beginning July 1 and ending
April 30. Prior notification must be made to the APCO.

401 . 12 Forest Management: Fires for the purpose of removing forest debris and for
forest management. The fires must be set or allowed by a fire official _
having jurisdiction, in the performance of fire duty, and must, in his
opinion, be necessary. Sections 5-111 . 1 and 5-111 .6 may be waived by `-
the fire official when deemed necessary in the public interest. Ail
materials shall be piled or windrowed unless deemed poor cultural practice
by the f?re official. Fires are limited to a period beginning November 1
and ending April 30.
401 . 13 Wildlife Management: Fires for the purpose of improvement of lowland and
marsh for..wiidlife and game habitat. The fire must be declared necessary
by the Department of Fish and Game. No-such fire may be allowed on a
given piece of land more than once in any 2 year period. The Department
of Fish and Game shall provide the APCO such information as may be deemed
necessaryby the APCO. Fires are limited to a period beginning February 1
and ending March 31, and a period beginning September 1 and ending
October 15; however, upon the determination of the APCO in consultation
with the Department of Fish and Game and the Solana County Mosquito
Abatement District,that heavy winter rainfall has prevented such burning,
the burn period beginning February 1 and ending March 31 may be extended
to no later than June 30. (Amended May 209 1981, August 3, 1983)
5-402 Repartings A written report of the location of an agricultural fire, the type of
material burned and the quantity of materiai'consumed must be submitted to the
APCO on forms provided by the District within 10 days following each fire so that
information as required by the ARS may be forwarded.
(Amended March 17, 1982)
5403 Agricultural Land Use Debris from land clearing shall not qualify under Sections 5-
401.19 5-401.2, 5-401.3, 5-401.4 or 5-401.5 unless applicant certifies, under
penalty of perjury, that said land is to remain in agricultural use for a gainful
occupation for a period of one year subsequent to the burning, end that applicant 4
has not caused or contributed to the need for the burning of the material for any
reason other than the promotion of agricultural use of the land for a gainful
occupation. However,the County Agricultural Commission may waive this Section
by certifying that burning of the material under Section 5-401.1 is, in his opinion,
the only safe method of disposal. Failure to comply with the conditions of this
Section shall be considered a violation of this Regulation. Each pile burned In
violation shall be cited as a separate offense.-.
5-404 Emergency Vaiverss A public officer authorized under Sections 5-401.1, 5-401.6
and 5-401.10 to grant permission foropen burning may grant waiversfrom Sections
5-1119 5-111.1 through 5-111.9 when,tnbisjudgment,such emergency or summary
action is necessary for the public safety. When such action is taken, the
authorizing authority shall certify the following in a report to the APCO within 10
days following the burnings a description and quantity of the material burned and an
explanation of the reasons for granting the permission.

for Solano County, Suisun Fire Protection District

A duck club or property owner must follow the following procedure
in order to obtain a Burn Permit for Wildlife Management.
1. Apply to the Department of Fish and Game, by filling out
an application and providing a map of the marsh area to
be burned.
2. The application and map, if approved by Fish and Game,
is then sent to the Suisun Fire Protection District.
3. The Burn Permit is then issued by the Suisun Fire
Protection District and notification is given to the
B.A.A.Q.M.D. (Air Pollution) which is required by
B.A.A.Q.M.D. Regulation 5.
4. Additional requirements are as follows:
A. Clubs may only burn 100 acres of land per section
of marsh land per day. The maximum number of burns
per day in the entire marsh area is six ( 6 ) burns.
The definition of a section of marsh land was not
exactly known by Suisun Fire Protection District,
but the sections are designated on a map.

Concerning Agricultural Burning

The Fish and Wildlife Study Committee has discussed the Board referral
concerning uncontrolled burning in the Delta area.
The Committee feels that controlled burning of wetland/marsh habitat
is an accepted method of managing marshes and wetlands. The Committee
feels that burning should be allowed as a management tool as long as
it is controlled. The Committee decided not comment on the issue as
to whether fires on marshes which are uncontrolled should be
contained. They felt that this was an issue for fire agencies to
discuss.
A study in the Webb Track/Sherman Island area is underway through the
University of California sponsored by the Department of Fish and Game.
It is likely that controlled burning would be a part of habitat
management for this area.

Subject: Burning in the Delta Area
Dear Mr. Van Marter:
I would like to respond to your memo to Chief Maxfield regarding
,fires occurring in the Delta area. Riverview has jurisdiction
over significant agricultural areas within our District as well as
administering Burn Permits for Volunteer Fire Districts. Also, as
County Fire Warden, I have duties limited to issuance and approval
of Burn Permits in County areas not within an organized Fire
District.
Of the two occasions Supervisor Torlakson has inquired of:
1. A controlled burn was performed on Winter Island, within
our District, under requirements of our permit.
Concurrently, there were several fires across the river
in Solano County, outside our jurisdiction.
2. A second occasion which received press reports of Fire
Officials allowing the fire to burn out occurred on
Sherman Island, also in Solano County which was, to the
best of my knowledge, either accidental or purposely set
without a permit.
Controlled agricultural burning done under our permit, within our
District or the Volunteer Districts, are relatively small and
accessible by fire apparatus. Our permit requires attendance by
the permittee at all times and extinguishing equipment be readily
available. The Bay Area Air Quality Management District declares
approved burn days daily based upon their air quality standards
and all burn permits are subject to this condition.
Fires occurring on isolated islands, possibly set by hunters, are
not accessible by typical fire apparatus (engines, power wagons,
etc. ) . The fuel, usually tulles, is so volatile that portable
pumps and small hoses are ineffective. These fires occur without
respect of burn day declarations of B.A.A.Q.M.D.

I would recommend that B.A.A.Q.M.D. regulations address wind
direction and the effect upon communities down wind from a
controlled burn. This of course would be very difficult to
administer as it would take specific site evaluation daily and
weather conditions are changeable.
I have attached District Burn Permit Requirements as well as
information gathered from Solano County regarding their permit
procedures. As you see, our permit requirements are to insure the
burning is done safely under the control of the permittee at all
times.
Health risks and air quality concerns would be properly addressed
by those respective agencies.

I. GENERAL REQUIREMENTS:
1. A Burning Permit is required for all open burning. (Issued to adults
only) .
2. Burning shall be prohibited on days of high winds (excess of 20 miles
per hour) .
3 . Burning shall be conducted with at least 30 feet of bare ground
surrounding fire area and at least 60 feet from any building or
combustible structure.
4. It is unlawful to burn garbage, animal matter, tires or any material
which may produce an obnoxious odor, soot or smoke.
5. There shall be at least one ( 1) adult in attendance at all times when
burning. This permit shall be in his/her possession or available for
immediate inspection by the enforcing agencies.
6 . Permittee may be charged for any response of equipment that may occur
as a result of fires not completely extinguished or fires that may
rekindle.
7. In case of emergency conditions, the Fire Chief or his fire
department officers may, by a verbal order, suspend or revoke this
permit.
II. AGRICULTURAL REQUIREMENTS:
1 . BURNING HOURS: 8: 00 AM (PST) until sunset.
2. No new material shall be added to the fire two hours before sunset.
3 . At termination of burning time ( sunset) , all burning shall be
extinguished, including smoke and steam.
4. Burning shall be restricted to days approved for burning by the Bay
Area Air Quality Management District.
5. Applicant' s signature on the Burn Permit Application affirms to Air
Quality the permit is to burn deciduous fruit and nut tree prunings
as a gainful occupation as required in Section 5-403 of regulation
No. 5 of the BAAQMD.
III. RECREATIONAL REQUIRIIENTS:
1. Fires used for cooking of food for human consumption or for
recreational purpose shall be restricted to clean firewood or
commercially manufactured fuels such as briquets, compressed logs,
etc.
2. All fires shall be extinguished when no longer needed, including
smoke and steam.
THIS PERMIT IS ISSUED WITH THE UNDERSTANDING THAT THE UNDERSIGNED ASSUMES ALL
RESPONSIBILITY FOR FIRE SPREAD OR FIRE DAMAGE THAT MAY RESULT FROM THE USE OF
THIS PERMIT.
