HomeMy WebLinkAboutORDINANCES - 07281987 - 87-64 ORDINANCE NO. 87-64 (Chevron Park Development Agreement) The Contra Costa County Board of Supervisors ordains as follows : Section I . After conducting a duly noticed public hearing and consideration of the appropriate environmental document, the Board hereby finds that the provisions of that certain Chevron Park Development Agreement between the County of Contra Costa and Chevron U.S.A. Inc. , a copy of which is on file with the Clerk of the Board, and which has been recommended for approval by the County Zoning Administrator, is consistent with the County ' s General Plan and conditions of approvals for the Chevron Park project. Section II. The Board hereby approves, pursuant to the authoriza- tion provided in Section 65864 et seq. of the Government Code of the State of California, entering into that certain Chevron Park Development Agreement between the County of Contra Costa and Chevron U. S.A. Inc. , subject to review and approval of the Community Development Department and County Counsel and provided that such Agreement shall not exempt the Chevron Park project from any future County ordinance requiring the establishment of child care facilities to the extent such ordinance would have been applicable to such project but for the Agreement. Section III . If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional or invalid, such a decision shall not affect the validity of the remaining portion of this ordinance. The Board hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase of this ordinance irrespective of the uncon- stitutionality of invalidity of any section, subsection, sub- division, paragraph, sentence, clause or phrase. Section IV. EFFECTIVE DATE. This ordinance becomes effective 30 days after passage, and within 15 days of passage shall be published once with the names of supervisors voting for and _ against it in the Contra Costa Times, a newspaper published in this County.
