SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION(S):
ADOPT Resolution No. 2008/accepting Deferred Improvement Agreement as Satisfied, for
Minor Subdivision 84-00084 (Parcel B), for project being developed by Charles H. and Roberta
Fuss, as recommended by the Public Works Director, Brentwood area. (District III)
FISCAL IMPACT:
None.
BACKGROUND/REASON(S) FOR RECOMMENDATION(S):
The Tamayos contributed funds to the State Route 4 Bypass Project, Segment 3 which constructed
the improvements specified in the Deferred Improvement Agreement.
CONSEQUENCES OF NEGATIVE ACTION:
The Deferred Improvement Agreement will not be exonerated.

SUBJECT: Accepting Deferred Improvement Agreement as Satisfied for Minor Subdivision 84-
00084(Parcel B), as recommended by the Public Works Director, Brentwood area.

On February 4, 1986,the Board authorized the Public Works Director to execute a Deferred
Improvement Agreement with Charles H. and Roberta Fuss for improvements along Marsh Creek
Road and Sellers Avenue as required by the conditions of approval for Minor Subdivision 84-00084.
The aforesaid Deferred Improvement Agreement was recorded on February 10, 1986 in
Volume 12737 of Official Records at page 73 and became an encumbrance against Assessor's Parcel
No. 007-140-023.

The Public Works Director now informs this Board that the requirements outlined in said
agreement have been satisfied.
The Board hereby FINDS that the conditions of the above-mentioned Deferred Improvement
Agreement are satisfied.
NOW THEREFORE BE IT RESOLVED that the aforesaid Deferred Improvement
Agreement is EXONERATED.
