BACKGROUND/REASON(S)FOR RECOMMENDATION(S): The Crockett Community Services District has amended its conflict of interest code and submitted the revised code to the Board for approval pursuant to Government Code sections 87306 and 87306.5. Marchesi, County Counsel By: Mary Ann Mason, Deputy County Counsel Re: Conflict of Interest of Code of the Crockett Community Services District Attached hereto are amendments to the Conflict of Interest Code for the above-named entity. The amendments are approved as to form. As you indicated in your August 26, 2008 transmittal memo, the District's April 7, 2008 request was found misfiled at the Clerk of the Board. We received it at our office on August 27, 2008. Please place this matter on the Board of Supervisors' agenda as requested. A board order is attached. MAM/bw Attachments cc: Kent Peterson, Manager, Town of Crockett IIBECKYNAM\Crockar CSDmimmu.wyd RESOLUTION NO. 07/08-07 A RESOLUTION ADOPTING A CONFLICT OF INTEREST CODE WHEREAS, the Crockett Community Services District has previously adopted Resolution No. 06/0.7-11 establishing a conflict of interest code for the District; and WHEREAS, the District Board of the Crockett Community Services District now finds it necessary that the positions of Commissioner, District Secretary, and Department Manager be added to Exhibit ."A" as designated positions . NOW, THEREFORE, BE IT RESOLVED that the text and Exhibits A&B of Resolution No . 07/08-11, as amended above, are hereby adopted as the Conflict of Interest Code of the District . THE FOREGOING RESOLUTION was adopted at the District' s Regular Meeting held on February 27 , 2008 by the following vote : AYES : Burlison, Loveseth, MacKenzie, Rock NOES: None ABSENT: Petty Johf` M Kenzie, Vice President ATTEST: i Kent G. Peterson District Secretary 0 WHEREAS, the Political Reform Act (Government Code Section 81000., et seq . ) requires state and local government agencies to adopt and promulgate conflict of interest codes . The Fair Political Practices Commission has adopted a regulation (2 Cal . Code of Regs . 18730) which contains the terms of a standard conflict of interest code . After public notice and hearing it may be amended by the Fair Political Practices Commission to conform to amendments in the Political Reform Act . Therefore, the terms of 2 California Code of Regulations Section 18730 and any amendments to it duly adopted by the Fair Political Practices Commission are hereby incorporated by reference . BE IT RESOLVED that this regulation and the attached Appendix designating officials and employees and establishing disclosure categories , shall constitute the conflict of interest code of the Crockett Community Services District . Designated employees shall file their statements with Crockett Community Services District , which will make the statements available for public inspection and reproduction. (Gov. Code Section 81008 . ) Statements for all designated employees will be retained by the Crockett Community Services District . EXHIBIT "A" Designated Positions Disclosure Category Members of the Board of Directors 1 and 2 Crockett Community Services District Commissioner 1 and 2 District Secretary 1 and 2 General Manager 1 and 2 Board Legal Counsel 1 and 2 Engineering Consultant 1 and 2 Department Manager 1 and 2 EXHIBIT "B" Disclosure Categories An investment , interest in real property or income is reportable if the business entity in which the investment is held, the interest in real property, or the income or source of income may foreseeably be affected materially by any decision made or participated in by the designated employee by virtue of the employee ' s position . Designated Employees in Group " 1 " must report : All investment , interests in real property and income, and any business entity in which the person is a director, officer, partner, trustee, employee, or holds any position of management . Financial interests are reportable only if located within the Crockett Community Services District , County of Contra Costa, State of California, or if the business entity is doing business or planning to do business in the District (and such plans are known by the designated employee) or has done business within the District at any time during the two years prior to the filing of the statement . Des ignaLed Employees in Group 112 " must report : Investments in any business entity and income from any source and status as a director, officer, partner, trustee, employee or holder of a position of management in any business entity which, within the last two years, has contracted, or in the future foreseeably may contract with the Crockett Community Services District , County of Contra Costa, State of California, to provide services, supplies, materials, machinery or equipment .
