SUBJECT: Approval of Emergency Residential Care Placement Extension and Novation Agreements
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
The Board, on November 1, 1983, having approved standard form Emergency Residential Care
Placement Agreements with the residential care facility operators specified on the attached
Addendum for the period November 1, 1983 through June 30, 1984, with an automatic six-month
extension through December 31, 1984, and
The State Department of Mental Health not yet having advised the County of the new rates to
be effective on or about January 1, 1985, the Health Services Director requests Board
actions as follows:
RECOMMENDATION
1. Authorize extension of the rates and services established under the Board's Order dated
November 1, 1983, and
Authorize the Auditor-Controller to continue paying the Contractors listed on the
attached Addendum for care and supervision of clients, as well as for the client 's inci-
dental expenses and personal needs, as specified under the prior agreements which are
expiring December 31, 1984, pending receipt of new rates from the State Department of
Mental Health; and
2. Authorize the Director, Health Services Department , or his designee, Gale Bataille, to
execute, on behalf of the County, standard Emergency Residential Care Placement
Agreements with the said residential care facility operators , novated back to
January 1, 1985, or as required by the State Department of Mental Health, upon his
receipt of the new rates allocated by the State.
BACKGROUND
For several years the County has contracted with various Board and Care facility operators
for emergency residential care of mental health patients under the County's Continuing Care
(Short-Doyle Opt-Out) Program.
The State Department of Mental Health customarily increases annually the rates to be paid
for the care of these patients. In October the Alcohol/Drug Abuse/Mental Health Division
received a letter from the State Department of Mental Health indicating that there will be a
rate increase and promising early notification of the new rates. However, despite follow-up
by the Health Services Department , the new rates have not yet been announced.
The purpose of this Board Order is to provide a mechanism which will assure continuity of
vital services to mental health patients and facilitate payment to facility operators and
patients while avoiding the burden of paperwork required for processing twenty-seven short-
term extensions as the County anticipates the State's new rate schedule for this program.
