REASONS FOR RECOMMENDATION/BACKGROUND: This recommendation will allow the Cities, Schools & Special Districts to consolidate with the November 4, 2008, General Election. These consolidations are based upon Election Codes 10400-10403.5. CONSEQUENCES OF NEGATIVE ACTION: Cities and Districts would not be able to consolidate for the upcoming November 4, 2008 General Election. San Ramon, City of 2008-122 Walnut Creek School District 07-08-27 Walnut Creek, City of 08-25 West Contra Costa Unified School District 87-0708 Agencies Requestsing November 2008 Election Consolidation West Contra Costa Unified School District 91-0708 West Count Wastewater District 7-01-08 loversize map attached RESOLUTION NO. 44-08 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANT HILL REGARDING THE CONDUCT OF THE MUNICIPAL ELECTION TO BE HELD NOVEMBER 4, 2008 WHEREAS, the City Council has ordered a Municipal Election to be held on Tuesday, November 4, 2008, to fill certain municipal offices; and WHEREAS, other elections may be held in whole or in part of the territory of the City and it is to the advantage of the City to consolidate pursuant to the State of California Elections Code Section 10400; and WHEREAS, Elections Code Section 10242 provides that the governing board shall determine the hours of opening and closing the polls; and WHEREAS, Elections Code Section 10002 requires the City to reimburse the County in full for the services performed upon presentation of a bill to the City by the County elections official; and WHEREAS, Elections Code Section 13307 requires that before the nominating period opens, the governing body must determine whether a charge shall be levied against each candidate submitting a Candidate Statement to be sent to the voters; and may estimate the cost; and may determine whether the estimate must be paid in advance; and WHEREAS, Elections Code Section 12101 requires the publication of a notice of the election once in a newspaper of general circulation in the City; and WHEREAS, tie votes shall be determined by lot unless the City Council adopts the provisions of Elections Code 15651(b)prior to the conduct of the election resulting in the tie vote. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Pleasant Hill hereby orders that an election be held in accordance with the following specifications: 1. The election shall be held on Tuesday, the 4th day of November 2008 The purpose of the election is to choose successors for three City Councilmembersl one City Clerk and one City Treasurer,}7with terms ending November 2012. 2. The election shall be consolidated with other elections which may be held in whole or in part of the territory;of the City, as provided in Elections Code 10400. 3. The hours the polls are to be kept open shall be from 7:00 a.m. to 8:00 p.m. 4..1 The City will reimburse the County for the actual cost incurred in conducting the election upon receipt of a bill stating the amount due as determined by the elections official. This sum is a partial payment for the cost of such statements. It is estimated that the total cost for the Candidate Statement will be $700.00. When the City receives an invoice for the printing costs of the Candidate Statements, it will bill the candidate for the balance of hits or her pro rata share. The candidate must pay the balance within 30 days of the City's billing; date. 7. The period for filing nomination papers shall commence on July 14, 2008. The deadline for filing nomination papers will be August 8, 2008, at 5:00 p.m. provided, however, that if nomination papers for an incumbent elective officer are not filed by said date and time, the voters will have until 5:00 p.m. on August 13, 2008, to nominate candidates other than the incumbent for such office. 8. The City of Pleasant Hill is to publish the Notice of Election in the Contra Costa Times, which is a newspaper of general circulation that is regularly circulated in the City. 9. In the event that two or more candidates receive an equal number of votes, the resolution of the tie voter will be by lotf pursuant to Elections Code Section 15651. 10. The City Council directs that a certified copy of this Resolution be forwarded to the Registrar of Voters and the Board of Supervisors of Contra Costa County and that a copy be t, given to each candidate or candidate's representative at the time nomination papers are isswip. NOW, THEREFORE, BE IT RESOLVED that the Board of Directors of the East Contra Costa Irrigation District does resolve as follows: SECTION 1. GENERAL PROVISIONS. Pursuant to Section 13307 of the Elections Code of the State of California, each candidate for elective office to be voted for at an election held in the East Contra Costa Irrigation District, may prepare a Candidates Statements on an appropriate form provided by the Registrar of Voters in Contra Costa County. Official Declarations of Candidacy for eligible candidates desiring to file may be obtained from the office of the Contra Costa County Clerk at 555 Escobar Street, Martinez, California, commencing on July 14, 2008. A Declaration of Candidacy must be filed at the office of the Contra Costa County Clerk during regular office hours, not later than 5:00 p.m. on August 8, 2008 unless the incumbent for such office fails to file, in which event the filing deadline is extended to 5:00 p.m. on August 13, 2008, to non-incumbents only. SECTION 2. CANDIDATE QUALIFICATIONS. To be qualified, a candidate for the office of Director of the East Contra Costa Irrigation District must be a registered voter and a free-holder of land within the District (at large}; must be a resident of the Division for the office of Director for which he or she wishes to run (nominated), and must be elected by Division. SECTION 3. CANDIDATES STATEMENT. The Candidates Statement may include the name, age and occupation of the candidate and a brief description of no more than 250 wordsf the candidate's education and qualifications expressed by the candidate him/herself. The statement shall not include party affiliation of the candidate, nor membership or activity in partisan political organizations. The statement shall be filed in the Office of the Registrar of Voters in Contra Costa County at the time the candidate's nomination papers are filed. The statement may be withdrawn, but not changed, during the period for filing nomination papers and until 5:00 p.m. on the next working day after the close of the nomination period. SECTION 4. ADDITIONAL MATERIALS. No candidate will be permitted to include additional materials in the sample ballot package. SECTION 5. COSTS. All costs incurred by the candidate shall be borne by the candidate and shall be paid in full at the time of filing his/her Candidates Statement. SECTION 6. APPOINTMENTS. An appointment to each of the above described elective offices will be made pursuant to Section 10515 of the Elections Code in the event there are no nominees or an insufficient number of nominees for such office and a petition for election is not presented to the Contra Costa County Clerk by 5:00 p.m. on August 18, 2008. The Nomination Period for circulation of nomination petitions shall be from Monday, July 14, 2008 (first day for pickup and circulation of nomination petitions) until 5:00 p.m., Friday, August 8, 2008 (last day for filing nomination petitions). Extended Nomination Period - If an incumbent fails to file by the August 8 deadline, any qualified person, other than the incumbent, will have until 5:00 p.m. on Wednesday, August 13, 2008, to file Nomination Papers. 7. The Boards of Supervisors of Alameda and Contra Costa Counties are hereby authorized and requested to canvass the returns of said East Bay Regional Park District election with respect to votes cast within said counties for this election and to certify the results of said election to the Board of Directors of the East Bay Regional Park District when such results are available. 13. The East Bay Regional Park District election shall be held in all respects as one election and only one ticket or ballot shall be used thereat, and the election precincts, polling places, voting booths and election officials shall be the same as for the Statewide General Election. 14. Notice of the election called by this resolution shall be given by publication of such notice in a newspaper of general circulation published in the District — Bay Area Newspaper Group - and such publication shall be deemed sufficient notice of said election (Election Code Section 121 12). 15. Following canvass of the returns and certification of the results of the election by the Boards of Supervisors of Alameda and Contra Costa Counties, a resolution of the results of the District election shall be adopted by the District Board giving the total votes cast in each of the five Wards (Wards 1, 2, and 4) and declaring the person receiving the highest number of votes in each Ward as Director. The persons so declared elected for Wards 1, 2, and 4 shall be sworn into office with the terms of office commencing the first Monday after the first day of January, 2009 (Public Resources Code Section 5533). 16. All other rules and regulations governed by the Elections Code for the conduct of this Statewide General Election on Tuesday, November 4, 2008, and the filing of nomination papers not specifically cited in this resolution shall be applicable to the District election. 17.
