ADOPT Resolution No. 20081 accepting the Final Engineer's Report for the County Service Area M-30 (Alamo Springs)and levying the annual assessments of police,parks&recreation,and road maintenance services to be placed on the tax roll for Fiscal Year 2008/2009. FISCAL IMPACT: There is no impact to the County General Fund. All costs will be covered with revenue from Countywide Service Area M-30 (Alamo Springs). (County Service Area M-30 Funds)(District III)Project No.: 7499-6X5491 DATE: August 5, 2008 PAGE: 2 REASONS FOR RECOMMENDATIONS AND BACKGROUND: On July 8, 2008, the Board of Supervisors adopted Resolution No. 2008/489 accepting filing of the Preliminary Engineer's Report for County Service Area M-30(Alamo Springs)for Fiscal Year 2008/2009,declaring the intent to levy and collect annual assessments,and fixing August 5,2008 at 9:30 a.m.,in the Board Chambers,as the time and place for a public hearing accepting the filing of the Final Engineer's Report. The annual assessments for CSA M-30 are for the purpose of funding municipal services provided by the Town of Danville to the residents living in the unincorporated portion of the Alamo Springs subdivision under a JEPA between the County and the Town of Danville. These services include: police,parks &recreation, and road maintenance. A portion of the assessment is also paid to the County's L-100 Lighting District. CSA M-30 was first formed in 1997. Residents were first assessed beginning in 2000. CSA M-30 includes a cost-of-living adjustment to compute the Maximum Total Assessment(MTA) authorization. The MTA is currently at $808.17. Funds collected through the assessment are used primarily to reimburse the Town for the cost of providing the above-stated municipal services. CONSEQUENCES OF NEGATIVE ACTION: Without the Board of Supervisor's approval, CSA M-30 will not receive funds sufficient to pay the sum requested by the Town of Danville. Notice of the hearing was given in the time and manner required by law. WHEREAS,at the public hearing,the Board afforded to every interested person an opportunity to comment in support or opposition to the levy of assessments, either in writing or orally, and the Board considered those comments. The Board then closed the public hearing. Assessment on Each Parcel Each parcel described by the Assessment Roll shall be assessed: $795.00 in Fiscal Year 2008/2009. Methodology for Calculating Assessments The Extended Services Assessment is calculated on a per parcel basis. Factors driving the cost of such assessment include:the fee required to be paid to the Town of Danville for provided municipal services;the transfer of the L-100 Lighting Assessment;the number of developed parcels within the district;the cost of administrative and accounting services provided by the County; and the need to fund a reserve for any increased or deferred expenditures. The assessment revenue is used to pay for the Extended Service costs of reimbursing the Town of Danville, funding the area's contribution to County Service Area L-100 (CSA L-100), and administrative overhead. Those costs are apportioned among the developed parcels in CSA M-30.
