HomeMy WebLinkAboutMINUTES - 12111984 - T.8 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on December 11 , 19849 by the following vote: AYES: Supervisors Powers , Fanden, Schroder, Torlakson NOES: None ABSENT: Supervisor McPeak ABSTAIN: None SUBJECT: Decision on appeal of Mary Lou Cox, (applicant & owner) , from Board of Appeals denial of appeal of Condition 2B(a) from conditions of approval of Minor Subdivision 52-84 in the Knightsen area. The Board on December 4, 1984, closed the public hearing and deferred decision to this date on the appeal of Mary Lou Cox, (applicant & owner) from Board of Appeals denial of the appeal of Condition 2B(a) from conditions of approval of MS 52-84 in the Knightsen area; and Supervisor Torlakson described the situation leading up to the appeal filed by Mary Lou Cox and stated that at one time , this application had been approved without the conditions of Collect and . Convey, and commented that the approval expired because the applicant did not meet the time limits for filing of the subdivision map, and stated that the applicant then went through the process of filing a new map. Supervisor Torlakson inquired of County Counsel if there were any procedures whereby the applicant could appeal the decision that the map had expired; and Victor Westman, County Counsel , advised that when a ten- tative map is approved there is a period to come back to the County with a parcel map, and stated that the applicant can ask for an extension, but that it is necessary to file a request for extension within the period of the original approval , and advised that it has been over a year and a half past the period in which a request for extension could have been filed; and Supervisor Torlakson commented that the Public Works Department had done some research as to whether there have been any variances of the Collect and Convey requirements in this area; and Dave Jewett , County Public Works Department , stated that no variances had been granted in recent years on less than 10 acre parcels , and commented that although he sympathized with the applicant in this situation, he did not feel he could recommend a variance from the patterns folowed for the last four years; and Supervisor Torlakson advised that he had toured the subject property, and stated that under the circumstances his recommendation would be to deny the appeal . Board members having considered the matter, IT IS ORDERED that the recommendation of Supervisor Torlakson is APPROVED and the appeal of Mary Lou Cox from the Board of Appeals denial of appeal of condition 2B(a) from conditions of approval of Minor Subdivision 2B(a) is DENIED . 1 hereby.certify that this Is a We and correct copy of an action taken and entered on the minutes of the Board of Supt IS n on the date shown.
