THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on December 11 , 1984 , by the following vote:
AYES: Supervisors Powers , Fanden, Schroder , Torlakson
NOES: None
ABSENT: Supervisor McPeak
ABSTAIN: None
SUBJECT: Hearing on recommendation of County Planning Commission
. with respect to rezoning application 2609-RZ and Develop-
ment Plan 3039-84 and Tentative Map filed for Subdivision
by J . D . Snow (applicant) , and MCS Corporation (owner) ,
to rezone land in the West Pittsburg area.
The Board on December 4 , 1984, continued to this date its
hearing on the recommendation of the County Planning Commission with
respect to rezoning application 2609-RZ to rezone approximately 2.5
acres from Two-Family Residential District (D-1 ) and Retail Business
District (R-B) to Multiple Family Residential District (M-29) , and
request for approval of Development Plan 3039-84 and Tentative Map
filed for Subdivision 6501 by J . D . Snow (applicant) , and MCS
Corporation (owner ) , in the West Pittsburg area; and
Harvey Bragdon, Assistant Director of Planning, described
the property site and advised that the Planning Commission recom-
mended approval with conditions and that a Negative Declaration of
Environmental Significance was filed for this project; and
Supervisor Torlakson requested that , as in in other projects
in the West Pittsburg area, a condition for fire fees be included in
the conditions of approval; and
Chairman Torlakson opened the public hearing, and the
following persons appeared:
J . D . Snow, applicant , appeared and commented that he was
uncertain as to the condition for fire fees , and stated that he was
prepared to meet all of the conditions imposed for this project , '
including fire fees , and also commented that the zoning for this
project conforms with the General Plan for this area, and stated
that he was not requesting any variances for this project , and urged
the Board to approve rezoning application 2609-RZ with conditions
and Development Plan 3039-84; and
Zola Gouig, 161 Riverside Place , Pittsburg, appeared in
opposition to the proposed project and expressed concern with respect
to the traffic problems in this area , and also stated that mitigation
measures would need to be taken with respect to the accommodations
for fire trucks , commenting that there was only one planned entrance
for the project , and also inquired as to how the widening of Willow
Pass Road in this area could be classified as a County project; and
Supervisor Torlakson advised that the widening of Willow
Pass Road could be done as an off-site project; and
Zola Gouig, also inquired as to what the purpose of a
General Plan was if the zoning could be changed over the opposition
and public outcries of the residents in the proposed project area;
and
Midge Dover , 161 Riverside Place , Pittsburg, appeared in
oppposition to the proposed project , and expressed her concerns with
respect to the Environmental Checklist which was prepared for this
project , expressed concerns with respect to the increased amount of
traffic in this area, which she felt this project would generate,
f stated that with only 2 proposed garbage receptacles for' this project ,
she felt there would be a significant problem with garbage , and com-
mented that the schools in this area were faced with severe problems
of overcrowding; and
Harvey Bragdon advised that the conditions of approval for
this project did not specify the number of garbage bins or recep-
tacles , only the proposed location for those receptacles; and
Supervisor Fanden commented that she felt that at least 8
garbage receptacles would be needed for a development of this size;
and that there should be additional receptacles to be utilized for
recycling, and recommended that this be added to the conditions of
approval for Development Plan 3039-84; and
. Supervisor Torlakson commented that he was not aware of
any problems with overcrowding of the schools in the Mount Diablo
School District , and stated that when projects of this nature come
before the Board the school districts affected are notified and
asked to comment on the proposed impact to the schools , and stated
the he had received no comments from the Mount Diablo School District
with respect to problems in this area; and
Supervisor Torlakson also commented that he felt this pro-
ject was in conformance with the General Plan for this area, and
stated that he toured the subject property, and also inquired as to
the County Public Works Department' s opinion of the traffic circula-
tion in this area; and
Boyd Jewett , County Public Works Department , commented
that the Public Works Department was satisfied with the conditions
of approval imposed for this specific project; and
Supervisor Torlakson commented that West Pittsburg is an
area which is rapidly changing, and stated that he felt new housing
was a positive step in the direction of upgrading this area, commented
that he felt this was a good project , and recommended the Board
approve the project , and add conditions as agreed to by the appli-
cant with respect to fire fees and also a condition for the
appropriate number of garbage receptacles for garbage and recycling
purposes , and also suggested that the applicant contact Many Hands
Recycling Center to work out some type of recycling program for this
project; and
Board members considered the matter , IT IS ORDERED that
rezoning application 2609-RZ is APPROVED as recommended by the
County Planning Commission and that Development Plan 3039-84 is also
APPROVED subject to conditions imposed by the Planning Commission and
the Board of Supervisors as set forth in Exhibit A attached hereto
and by reference incorporated herein, and the Board hereby adopts
the Planning Commission' s reasons , set forth in its Resolution
Number 55-1984 as its determinations for this decision.
IT IS FURTHER ORDERED that Ordinance Number 85-1 giving
effect to the aforesaid rezoning is INTRODUCED , reading waived and
January 8, 1985, is set for adoption of same .
