The Board on November 27, 1984, deferred to this date its decision on the appeal of DeBolt Engineering (applicant ) , and Smith & Creese (owners) , from the Board of Appeals decision denying appli- cation for Minor Subdivision MS 2-84, requesting approval to divide 3.7 acres into three lots to be less than 250-ft . in average width ( 116-ft , 125-ft and 143-ft ) , in the Walnut Creek area; and Supervisor Schroder commented that the subject area has for many years been a Country Estate area, and that subsequently the character of this area has changed from Country Estate to a hospital and medical buildings , and also commented that based on his conver- sations with County staff and the City of Walnut Creek , the request for three lots would be reasonable in the area, and recommended that the Board grant the appeal with conditions as proposed by the County Planning Commission. This request is approved for three parcels.. The following conditions require compliance prior to filing the Parcel Map unless otherwise indicated. 2. This approval is conditional upon submittal of an application by the developer to rezone the property to Single Family Residential District (R-40) prior to recording. the Parcel Map. 3. The zoning variances are approved as requested; they meet the requirements of Section 26-2.2006 of the County Ordinance Code. 4. If archaeologic materials are uncovered during grading, trenching or other on-site excavation, earthwork within 30 meters of these materials shall be stopped until a professional archaeologist who is certified by the Society for California Archaeology (SCA) and/or the Society of Professional Archaeology (SOPA) has had an opportunity to evaluate the significance of the find and suggest appropriate mitigation measures, if they are deemed necessary. 5. The applicant shall submit a preliminary soil and geologic deport for review and approval of the Planning Department 45 days prior to recording the parcel map or issuance of Building Department permits. The investigation requires subsurface exploration. It shall give consideration to site grading, drainage and foundation design, placement of structures, road design, and retaining wall foundation design. 6. Sewage disposal serving the properties concerned in this application shall be provided by the Central Contra Costa Sanitary District. Wherever possible each individual living unit shall be served by a separate sewer connection. The sewers located within the boundaries of the properties concerned should become an integral part of the Central Contra Costa Sanitary Disrict's sewerage collection system. 7.. Water supply serving the properties concerned shall be by the East Bay Municipal _ Utility District. Wherever possible, each individual living unit shall be served by a separate water connection. Such water distribution system, located within? the boundaries of the properties concerned in this application, should become an integral part of the East Bay Municipal Utility District's overall water distribution system. 8. Access to Parcels B and C shall be combined as indicated on the site plan by Paul Ballora, AIA, received by the Planning Department on May 8, 1984. The private road shall be designed to Ordinance Standards where it serves both parcels. Grading, .drainage, site development plans for both parcels, as well as improvement plans for the private road, shall be subject to review by the Zoning Administrator. Any yard variance requires approval of an application for the variance. 9. A grading permit will be required for the earthwork necessary to develop all parcels in the above minor subdivision. 10. Submit four (4) copies of plans showing the existing contours, the extent of the proposed grading, drainage improvements and general site development. ►, MS 2-84 Page 2 11. The plansaccompanying the application for building permits shall show the existing contours, the extent of the proposed grading and drainage improvements, and be reviewed by the Grading Section prior to issuance. 12. A licensed soil engineer may be required to control grading operations and to report on the ability of the site to support the improvements anticipated. 13. Typical cross-sections of the proposed access road improvements shall be shown on. the above plans. 14. Comply with the requirements of the Public Works Department as follows: A. In accordance with Section 92-2.006 of the County Ordinance Code, this subdivision shall conform to the provisions of the County Subdivision Ordinance (Title 9) . Any exceptions therefrom must be specifically listed in this conditional approval statement. B. The following exceptions to Title 9 are permitted for this subdivision: 1. Section 914-2.006 "Surface Water Flowing from Subdivision. " Subsection (a) provided that: i . Surface waters flowing from the subdivision in any form or matter shall be conveyed without damage to any improvement building or dwelling to a natural watercourse having a definable bed and banks or to an existing acceptable storm drainage facility. Storm drainage facilities to be constructed outside of the subdivision shall be designed to adequately convey the storm water runoff from the ultimate development of the drainage basin or watershed lying within and above the subdivision. The existing drainage facility within the City portion of Arbol Via shall be considered an acceptable point of discharge. ii. Prior to the filing of the parcel map, pay the drainage fees outlined in the Drainage Fee Ordinance for Specific Plan No. 6 area as adopted by the City of Walnut Creek . These funds will be transferred to the City for the purpose of improving inadequate drainage facilities downstream of MS 2-84. 2. Section 914-4 .402, "Discharge to Roadside Ditches, " provided the applicant verifies the adequacy of the downstream ditch system or constructs necessary improvements to upgrade the system to adequately convey runoff from this property. C. Execute a Deferred Improvement Agreement requiring the owners of the property involved in Subdivision MS 2-84 to: I.
