DETERMINE the Contra Costa County(County) owned parcel identified as an additional part of Basin`B" along State Highway 4 in connection with the State Route 4 East,Bailey Road Interchange Project(Project),to be no longer necessary for County purposes. 2. APPROVE the conveyance of this additional County owned parcel identified as part of Basin `B", to the Agricultural-Natural Resources Trust of Contra Costa County(Trust)pursuant to Streets&Highways Code Section§ 960. 3. AUTHORIZE the Chair,Board of Supervisors,to execute the Grant Deed on behalf of the County. 4. DIRECT the Real Property Division of Contra Costa County to have the above referenced Grant Deed delivered to Financial Title Company for recording in the Office of the Contra Costa County Recorder. (District V) [CDD 990-6] Project No. 4660-6X4158 DATE: August 5, 2008 PAGE: 2 of 2 FISCAL IMPACT: There is no impact to the County General Fund. REASONS FOR RECOMMENDATIONS AND BACKGROUND: The County acquired this real property on behalf of Contra Costa Transportation Authority (CCTA) for the sole purpose of mitigating wetland impacts associated with the Project. The site must be preserved as wetland mitigation and CCTA wishes to transfer the parcel to the Trust as it is a California public benefit corporation authorized to hold Conservation Easements pursuant to section 815.3 of the California Civil Code in order to meet the obligations and long term management activities. In December of 2007,three parcels identified as Basin`B"were conveyed. In order to complete the full intended conveyance,this fourth parcel which is part of Basin"B"needs to be conveyed. CONSEQUENCES OF NEGATIVE ACTION: The County would own and be responsible for the maintenance and management of a wetland mitigation site that is a part of an earlier conveyance in which the Board took action on in December of 2007.
