SUBJECT: Adoption of an Urgency Ordinance and Introduction of an Ordinance to Extend the
Terms of the Regional Planning Commissions (Districts III, IV and V)
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
1. ADOPT Urgency Ordinance 2008-26, extending the terms of the East County Regional
Planning Commission and the San Ramon Valley Regional Planning Commission for one
year.
2. INTRODUCE Ordinance 2008-28, extending the terms of the East County Regional
Planning Commission and the San Ramon Valley Regional Planning Commission for one
year, WAIVE reading and FIX September 16, 2008 for adoption.
3. DETERMINE that the adoption of Ordinance 2008 -26 and Ordinance 2008-28 is exempt
from the California Environmental Quality Act (CEQA) in that it can be seen with certainty
that there is no possibility of a significant adverse effect on the environment.

Adopt Ordinance No. 2008-26 to extend the term of the
Regional Planning Commissions to October 6, 2009
4. DIRECT the Department of Conservation and Development to post Notices of Exemption
with the County Clerk.
BACKGROUND/REASONS FOR RECOMMENDATIONS:
The County Code provides for the automatic repeal of the sections that establish the East
County Regional Planning Commission and the San Ramon Valley Regional Planning
Commission on October 7, 2008 unless the Board otherwise provides before then. When this
issue was considered by the Board in 2007, the Board elected to continue the regional
commissions for one year, predominately to await the outcome of the Alamo incorporation
effort.
The Alamo incorporation effort has made significant progress in the intervening time period and
a vote could be held as early as March, 2009. As such, the Department recommends
continuing the regional commissions for one additional year at which time the outcome of the
incorporation effort will likely be known. The members of the regional planning commissions
and the members of the County Planning Commission have been informed of the staff
recommendation, and no concerns have been raised to date.
ADDENDUM
SDA August 19, 2008 Extending Regional Planning Commissions
Dennis Barry, Department of Conservation and Development, presented the staff report
on consideration to adopting Urgency Ordinance No. 2008-26, extending the terms of the
East County Regional Planning Commission and the San Ramon Valley Regional
Planning Commission for one year; and introducing Ordinance 2008-28, extending the
terms of the East County Regional Planning Commission and the San Ramon Valley
Regional Planning Commission for one year.
Supervisor Piepho said she has received comments of concern regarding the manner in
which the meetings were run. She said she would like information on how often each
commission holds meetings and the rotation of chairmanship of the commissions to be
brought back to the Board.
Mr. Barry noted that attendance information had been kept and the department would
prepare a report for the Board with that and information on the selection and rotation of
the chair of each commission.
There were no requests to speak on this matter.
By unanimous vote, Supervisor Gioia absent,the Board ADOPTED Urgency Ordinance
No. 2008-26, extending the terms of the East County Regional Planning Commission and
the San Ramon Valley Regional Planning Commission for one year; INTRODUCED
Ordinance No. 2008-28, extending the terms of the East County Regional Planning
Commission and the San Ramon Valley Regional Planning Commission for one year;
waived the reading, and fixed September 16, 2008 for adoption; and DIRECTED the
Department of Conservation and Development return to the Board a report regarding
each commission's attendance and Chair position rotation.

The Contra Costa County Board of Supervisors ordains as follows (omitting the parenthetical
footnotes from the official text of the enacted or amended provisions of the Ordinance Code):
SECTION I. SUMMARY. This ordinance is an urgency ordinance to extend the term of the
San Ramon Valley and East County regional planning commissions for one year.
SECTION II. Section 26-2.1514 of the County Ordinance Code is amended to read:
26-2.1514 Repeal. Sections 26-2.1510 and 26-2.1512 of the County Ordinance Code are
repealed and of no further force and effect beginning on October 6, 2009,unless this Board
otherwise provides before then. (Ords. 2008-26 § 2, 2007-46 § 2, 2007-45 § 2, 2003-20 §2,
2003-19 § 2, 99-50 § 2, 99-49 § 2, 97-36 § 1.)
SECTION III. URGENCY DECLARATION. This ordinance is an urgency measure to
protect the public safety,health and welfare pursuant to the authorization of Government Code
section 25123(d)by providing for the extended and continued existence of the San Ramon Valley
and East County regional planning commissions. The facts constituting the urgency are that if
this ordinance is not adopted, any scheduled hearings cannot be conducted, any decisions on
pending applications before the commissions cannot be made, and some applications may be
deemed approved,which would frustrate County Planning Agency land use regulations and
public hearing procedures.
SECTION IV. EFFECTIVE DATE. This ordinance becomes effective immediately upon
passage by four-fifths of the Board, and within 15 days after passage shall be published once with
the names of supervisors voting for or against it in the Contra Costa Times, a newspaper
published in this�Couny.

East County regional planning commissions for one year.
SECTION II. Section 26-2.1514 of the County Ordinance Code is amended to read:
26-2.1514 Repeal. Sections 26-2.1510 and 26-2.1512 of the County Ordinance Code are
repealed and of no further force and.effect beginning on October 6, 2009, unless this Board
