Re: Proposed Liberty Un. Sch.Dist. use . of "201" funds
On 12-5-84 you asked this office to examine the attached
11-14-84 memorandum from the Liberty Union High School District' s
Superintendent wherein he projects the District' s proposed
expenditure of its accumulated SB 201 funds. You asked our view
whether the District' s proposed expenditures of the subject SB 201
funds are in accordance with uses authorized by state law (Govt.C.
§§65970 - 65981) . We believe that the proposed expenditures of
SB 201 funds indicated on the attached memorandum are permited by
involved state statutes subject to the following comments.
First, the expenditures proposed in Items 2 . 1 and 2 . 2 of
the attached memorandum for permanent classroom facilities are
proper to the extent they are made as part of the 10 percent local
share necessary to obtain a State School Building Lease - Purchase
Law of 1976 grant (Govt.C. §65975) . The School District' s 11-14-84
memorandum indicates that these expenditures of SB 201 funds are
to be made as a 10 percent local share for such State grants.
Second, Item 2 . 3 of the 11-14-84 memorandum indicates
that the District proposes to acquire land for the placement of
temporary buildings. We believe such land purchases when made
with SB 201 Funds are proper only if the School District at the
time of purchase has reasonably used all of its existing real
property for the location of such temporary buildings and the land
rights it then acquires are limited to those sufficient to support
maintenance of such temporary buildings for their useful life.

District' s legal counsel, Mr. Robert T. Owens of Littler,
Mendelson, Fastiff & Tichy concerning the above-noted matter.
This office has no basis upon which to disagree with
your private legal counsel ' s opinion about the use which may be
made of interim school fees after January 1 , 1984 pursuant to
the provisions Government Code Section 65975 .

Dear Pete:
This firm acts as counsel to the Liberty Union
High School District which has received fees pursuant to
an ordinance of the County of Contra Costa enacted pursuant
to Government Code section 65970 and following.
The District desires to utilize a portion of the
fees collected to pay ten percent of the cost of projects
constructed in its attendance area under the State School
Building Lease—Purciiase Law of 13-76 . iii our upitiion, Liic
expenditure of the fees in this manner is authorized by
Government Code section 65975 .
The District requests an opinion from the County
Counsel whether such an expenditure is authorized.

Dear Pete : I
I met with Gary Brown of the County Administrator' s
Office on October 24 to discuss impaction fees. During the
course of our conversation, I pointed out the provisions of
Government Code section 65975. This recently enacted pro-
vision allows the District to use interim facility fees to
match grants from the State School Building Lease-Purchase
Law of 1976 . This represents a considerable departure from
language of section 65980 and its description of interim
facilities.
The Liberty Uni-on High School Distill t has numerous
project applications pending with the State of California and
will utilize interim fees to provide the ten percent matching
funds where appropriate .

Dear Senator Richardson:
This is a confirmation of an oral opinion which we
de'_ivered. to Michael Carrington of your office at your request on
July 12 , 1984 under Request No. 13908 .
Mr. Carrington asked whether under Chapter 4 . 7
(commencing with Section 65970) of Division 1 of Title 7 of the
Gover=, ent Code , local governmental entities are authorized to
provide by ordinance for the levying of fees for the builders of
residential developments where conditions of school overcrowding
exist fcr any of the following: ( 1 ) the 'purchase of a school
site , (2) the purchase , as opposed to the lease , of relocatable
build:ncs , or ( 3) the purchase of furniture and equipment for an
interim school facility.
We responded that although the matter is not entirely
clear , Chapter 4 . 7 may be interpreted to authorize the levying of
fees for the purchase of a school site , and, in the proper
factual setting , for the purchase , as opposed to the lease , of
relocatable buildings .
