SUBJECT: Proposed Interstate Truck Ordinance
The Board on December 4, 1984 continued to this date the
hearing on the proposed ordinance regulating interstate truck terminals
and truck terminal routes .
J . Michael Walford , Public Works Director , stated that he
had met with members of the trucking industry and they had expressed
concern with the language in the State law , and in particular , the
definition of "terminal" . He noted that an effort is being made to
get the language changed in the State law , but that the California
Highway Patrol (CHP) has the authority to enforce the law when it
becomes effective January 1 , 1985. He expressed the belief that it
is important from a liability standpoint for the County to have an
ordinance in effect at that time . He stated that at this time the
City of Lafayette is the only city in the County that has adopted
such an ordinance .
Jack Telfer , President , Telfer Tank Lines , P .O . Box 709 ,
Martinez 94553, appeared and stated that in his opinion the ordinance
was not needed because there is almost no difference in the trucks
already legally operating on California highways and those designated
interstate . He noted that there is no difference in size , weight
capacity or appearance , the only difference being a slightly increased
king pin setting on the interstate trucks which allows a wider turning
radius . He expressed his belief that the definitions and language in
State Law AB 866 would be clarified during the next Legislative
session, making any local ordinance unnecessary .
Baysul Parker , California Trucking Association , 1240 Bayshore
Highway, Burlingame 95010, appeared and commented on the economic
impact on the business community if the ordinance is adopted. He
noted that any individual or business establishment that qualifies
as a terminal under the current definition in AB 866 would be required
to apply for a permit and purchase signs .to be placed at freeway
off-ramps and street intersections giving directions to his terminal .
He stated that if the language and definitions in the State law are
changed , as the California Trucking Association and other interested
parties are attempting to do , such permits and signs would become
unnecessary, creating a financial loss to those who had purchased
them .
Mr . Parker noted that many cities and counties in the State
have chosen not to adopt an interstate truck ordinance , including the
City of Concord, which has withdrawn the ordinance recently introduced
in that city. He expressed the opinion that the ordinance would be
detrimental both to the trucking industry and the business community.
Supervisor Tom Powers advised that he felt that current laws
regulating truck weight and size , etc . were sufficient to protect the
community, and that efforts should be made to change the language of
the State law regulating interstate trucks .

Board members being in agreement , IT IS ORDERED that the
aforesaid ordinance regulating interstate truck terminals and access
routes is WITHDRAWN until such time as the language in State Law AB
866 is clarified with respect to the definition of .terminals .
