(100% Mental Health Services Act funds) (All Districts) FISCAL IMPACT: The total annual cost associated with the action is$157,969.82 and is within the Mental Health Services Act budget. BACKGROUND: Since 1998, the Health Services/Mental Health Division has been responsible for the preauthorization and management of all outpatient and inpatient mental health services, certifies all Medi-Cal mental health providers, provides financial services to mental health consumers, and provides all data collection and analysis for the Division, including the State-mandated reports. In addition, the Mental Health Division operates the State mandated Mental Health Access Line, provides state and federally mandated quality assurance functions, and ensures program compliance with all state and federal mandates, regulations and laws, including the HIPAA Compliance Program. In August 2003, new federal managed care regulations (Title 42 Code of Federal Regulations) required the design and development of a complicated system-wide internal auditing process, inclusive of the Mental Health Division's comprehensive Compliance Program. The new demands on the Mental Health Division warrants a high-level management position to oversee the increased, reporting requirements, research program outcomes, and unprecedentedcomplianceissues. CONSEQUENCE OF NEGATIVE ACTION: If this action is not approved, Health Services/Mental Health Division will not have the managerial and administrative oversight to ensure compliance with Title 42 Code of Federal Regulations,federal managed care regulations. Failure to comply could result in substantial monetary penalties imposed.upon the Health Services Department.
