(District 1II) SPI::CIFIC RLQUF.ST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION(S): ADOPT Resolution No. 2008/ accepting completion of warranty period and release of cash deposit for faithful performance, for Drainage Acceptance 03-00019 (cross-reference 03-08508), project developed by Windemere BLC Land Company, LLC, as recommended by the Public Works Director, San Ramon (Dougherty Valley) area. (District III) FISCAL IMPACT: None. BACKGROUND/REASON(S) FOR RECOMMENDATION(S): The Drainage Improvements have met the guarantee performance standards for the warranty period following completion and acceptance of improvements. CONS.EOUENCES OF NEGATIVE ACTION: The developer, Windemere BLC Land Company,LLC will not receive a refund of their cash deposit,the Drainage Improvement Agreement and surety bond will not be exonerated and the billing account will not be closed and liquidated. (District III) DATE: July 8, 2008 PAGE: 2 .BE IT FRUTHER RESOLVED that upon completion of the warranty and maintenance period, the developer, Windemere BLC Land Company, LLC, shall retain the drainage improvements for maintenance and ownership in accordance with the Geologic Hazard Abatement District(GRAD) plan of control, and until accepted by'the GHAD or the City of San Ramon. BE IT. FURTHER RESOLVED that the warranty perior has been completed and the Drainage Improvement Agreement and surety bond,bond no.08641806,dated May 14,2003,issued by Fidelity and Deposit Company of Maryland, are exonerated.
