SUBJECT: Proposed Ordinance Delegating Certain
Authority to the Purchasing Agent
In a December 5, 1984, memorandum , V. J . Westman, County
Counsel, advised that after January 1, 1985 , Government Code
Section 25502. 5 provides that any county with a population
in execess of 200,000 may , by ordinance, authorize its
purchasing agent to engage independent contractors where the
cost doesn't exceed $25 ,000. County Counsel transmitted for
Board consideration a proposed amendment to the Ordinance Code
of Contra Costa County (Section 1108-2 . 214) that would be
compatible with the State Code.
Board members having considered same and being in agree-
ment , IT IS ORDERED that the aforesaid Ordinance is INTRODUCED,
reading waived, and December 18, 1984 , fixed as the time for
adoption.

Re: Implementing $25 , 000 Purchase Agent Authority , Govt.C.
§25502 . 5 (AB 1609 - .Ch. 1094 , Stats . 1984)
Effective January 1, 1985 current Government Code §25502 . 4
is repealed (§2 Ch. 1094) . After January 1, 1985 amended
Govt..Code §25502 . 5 provides that any county with a population
in excess of 200 , 000 may, by ordinance, authorize its purchasing
agent to engage independant contractors where the cost doesn ' t
exceed $25 , 000 .
Attached is a proposed ordinance to .provide our Purchasing
Agent with the authority allowed by the amended provisions of
Govt.C. §25502 . 5 . Please present this .ordinance to the Board
of Supervisors in a timely manner so that its provision will
become effective as soon as possible after January 1 , 1985 .
Should it be determined that it is not desired that the
Purchasing Agent have the authority to execute contracts to
the $25 , 000 limit authorized by §25502 . 5 (after January 1 , 1985) ,
the Board of Supervisors by regulation (a resolution) could limit
the .Purchasing Agent ' s authority to some lessor amount. Thee
second sentence of §25502 . 5 provides the Board with this authority .
Also note that in subsection (b) (7) of §1108-2 . 214 of the
proposed ordinance, the current reference therein to now repealed
Streets and Highways Code §1074 is eliminated and corrected
reference made to Public Contract Code §20394 which has replaced
§1074 .

(On Purchasing Agent Services)
The Contra Costa County Board of Supervisors ordains as follows
(omitting .the parenthetical footnotes from the official text of
the enacted or amended provisions of the County Ordinance Code) :
SECTION I . Section 1108-2 . 214 of the County Ordinance Code is
amended, to provide for the $25 , 000 limit allowed by Ch . 1.094 ,
Stats. 1984 and Public Contracts Code §20394 , to read:
,1108-2 . 214 Independ_en_t contractors_. (a) General . He
shall engage contractors to perform services for the . county
and its offices, with or without the furnishing of material ,
where the aggregate cost does not exceed the amount authorized
in Government Code Section 25502 . 5 from time to time.
(b) Exceptions. Thissection does not apply to:
(2) Phonographic reporters services or transcripts;
(3) Special expert services for the district attorney' s ,
public defender' s , or sheriff ' s offices;
(4) Election supplies;
(5) Consultants and other experts employed directly
by the board;
(6) Other services which by law some other officer or
body is specifically charged with obtaining;
(7) Road equipment rented pursuant to Section 1108-2 . 208 ; w
and
(8) Contracts he lets pursuant to Public Contract Code
Section 20394 .
