RECOMMENDATION(S):
ADOPT Resolution No. 2008/ 914; accepting completion of private improvements for Minor Subdivision 03-
00018, project developed by Ted Liu, Walnut Creek area. (District III)
FISCAI. IMPACT:
None.
BACKGROUND/REASON(S) FOR RECOMMENDATION(S):
The private improvements have been completed as required by the improvement plans and in conformance with
the County Ordinance Code.
CONSEQUENCES OF NEGATIVE ACTION:
The Subdivision Agreement and perfonnance surety bond will not be exonerated.

SUBJECT: Accepting completion of private improvements (Iris Lane) for Minor Subdivision
03-00018, project developed by Ted Liu, as recommended by the Public Works
Director, Walnut Creek area. (District III)
These improvements are located near Boulevard Way.
The Public Works Director has notified this Board that the improvements in Minor
Subdivision 03-00018 have been completed as provided in the Subdivision Agreement with Ted
Liu, heretofore approved by this Board in conjunction with the filing of the Subdivision Map.

SUBJECT: Accepting completion of private improvements (Iris Lane) for Minor Subdivision
03-00018, project developed by Ted Liu, as recommended by the Public Works
Director, Walnut Creek area. (District III)

NOW THEREFORE BE IT RESOLVED that the improvements have been
COMPLETED as of July 8, 2008 thereby establishing the six-month terminal period for the
filing of liens in case of action under said Subdivision Agreement:

BE IT FURTHER RESOLVED the payment (labor and materials) surety for $28.450.00,
Bond No. 8690545 issued by the above surety be RETAINED for the six month lien guarantee
period until January 8, 2009, at which time the Clerk of the Board is AUTHORIZED to release
the surety less the amount of any claims on file.
BE IT FURTHER RESOLVED that the private improvements have been COMPLETED
and are NOT ACCEPTED NOR DECLARED as County Roads, at this time.
BE IT FURTHER RESOLVED that there is no warranty period required, and the Public
Works Director is AUTHORIZED to refund the"$569.00 cash security for performance
(Auditor's Deposit Permit No. 434403, dated November 10, 2004) plus interest in accordance
with Government Code Section 53079, if appropriate, to Ted Liu pursuant to the requirements of
the Ordinance Code; and the Minor Subdivision Agreement and surety bond, Bond No. 869.0545,
dated October 29, 2004, are exonerated.
