Schroder , Torlakson. NOES: None ABSENT: None . ABSTAIN: None . SUBJECT: Determination of Property Tax Transfer ) For Baker Annexation to Los Medanos ) RESOLUTION NO. 84/753 Community Hospital District, (LAFC '83-24) WHEREAS, Section 99. 1 of the Revenue and Taxation Code provides that a jurisdictional change resulting from a special district providing one or more services to an area where such services have not previously been provided shall not become effective if one or more affected special districts involved in the property tax exchange negotiation fails to adopt a resolution agreeing to a transfer; and WHEREAS, the Board of Supervisors shall determine the property tax exchange for each affected district that fails to adopt a resolution agreeing to a property tax transfer except for the annexing district; and WHEREAS, the Los Medanos Community Hospital District is the only affected agency in the Baker Annexation to Los Medanos Community Hospital District, and the District has requested that no property tax be exchanged as a result of the annexation. NOW, THEREFORE, BE IT RESOLVED THAT THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY HEREBY DETERMINES that no property tax will be transferred to the Los Medanos Community Hospital District as a result of annexing the territory described in the Baker Annexation to Los Medanos Community Hospital District (LAFC 83-24) . This resolution does not change the property tax revenues accruing to other agencies serving the subject territory or the affected districts ' right to collect taxes for existing bonded indebtedness. RESOLUTION NO. 84/ 752 to Byron Sanitary District ) (LAFC '84-13) ) WHEREAS, Section 99 .1 of the Revenue and Taxation Code provides that a jurisdictional change resulting from a special district providing one .or more services to an area where such services have not been previously provided shall not become effective if one or more affected special districts involved in the property tax exchange negoti- ation fails to adopt a resolution agreeing to a transfer; and WHEREAS, the Board of .Supervisors shall determine the property tax exchange for each affected district that fails to adopt a resolution agreeing to a property tax transfer except for the annexing district; and WHEREAS, Annexation No. 83-1 to Byron Sanitary District (BSD) proposes annexation of territory which results in provision of services not previously provided and no resolutions have been adopted agreeing to property tax exchanges; and WHEREAS, in the absence of a master agreement for property tax exchange between the County and BSD, the County and BSD agreed that the property tax exchange agreement for this annexation will be in accordance with the terms of the existing master agreement between the County and the Central Contra Costa Sanitary District and the East Bay Municipal Utility District. THEREFORE, BE IT BY THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY RESOLVED that the property tax increment allocation factors for the affected agencies in the area of Annexation No. 83-1 to Byron Sanitary District (LAFC 84-131 for the fiscal year for which the State Board of Equalization makes the tax rate area change (s) for the juris- dictional change and subsequent years, unless changed by the mutual agreem_ent _of affected agencies or subsequent jurisdictional changes shall be in accordance with the above master agreement and that the Auditor-Controller is directed to apply the terms of the master agree- ment between the County and the Central Contra Costa Sanitary District and the East Bay Municipal Utility District to the subject annexation, said increment tax allocation factors apply to affected territory as submi-tted or revised by the Local Agency Formation Commission. This resolution does not change the affected districts' right to collect taxes for existing bonded indebtedness. Orig.
