Director of Weights and Measures �' '� �°��'� �--:'..^;z Costa DATE: July 22, 2008 °°s ==xT `r County SUBJECT: Agreement #08-0125 between Contra Costa County and the State of California, Department of Food and Agriculture (CDFA) for Reimbursement for Regulatory work for the Light Brown Apple Moth SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION(S): APPROVE and AUTHORIZE the Agricultural Commissioner, or his designee, to execute an agreement between Contra Costa County and the State of California, Department of Food and Agriculture for reimbursement to the County for regulatory work for the Light Brown Apple Moth from July 1, 2008 through June 30, 2009. FISCAL IMPACT: The agreement reimburses the County for expenditures incurred from July 1, 2008 through June 30, 2009 in the amount of $113,368.50. BACKGROUND: The Light Brown Apple Moth ("LBAM") was first detected in Contra Costa County on March 7, 2007. In addition, LBAM was also detected in five San Francisco Bay Area counties including Santa Cruz, Solano and Monterey. Currently LBAM has additionally been detected in Sonoma and Santa Barbara counties. As multiple detections of LBAM continued, the Department proposed the emergency adoption.of Section 3434, Light Brown Apple Moth Interior Quarantine, adding portions of Contra Costa County, as well as, areas within the other counties mentioned. On May 2, 2007 the United States Department of Agriculture (USDA) issued a Federal Domestic Quarantine Order (DA-2007-42), regulating the interstate movement of host material from the infested areas of California and all of Hawaii. This regulation requires all nurseries, green waste facilities; community gardens and harvested commodities within the infested areas be issued a quarantine compliance agreement and be inspected every 30 days. On November 8, 2007, an emergency amendment to Section 3434 became effective that removed a quarantined area in Oakley and Danville; however, new regulated areas have been established since then in other portions of the County as LBAM continues to be detected. CONSEQUENCE OF NEGATIVE ACTION: Failure to approve Agreement #08-0125 will result in a loss of revenue to the Department of Agriculture in the form of lost compensation for work performed from July 1, 2008 through June 30, 2009. l
