DIRECT the Public Works Director to snail, by first class mail, the "Notice of Adoption of Resolution" (attached as Exhibit 3 to the Resolution) to each owner of real property(as shown on the last equalized.property tax roll of the Countyj that was annexed to the Hillcrest Heights GHAD on July 22, 2008, as shown on the Boundary Map (attached as Exhibit 2 to.the Resolution). The sealable Ballot (attached as Exhibit 4 to the Resolution) and the Engineer's Report (attached as Exhibit.l to the Resolution) shall be attached to the Notice of Adoption of Resolution. Processing costs have been paid by the applicant. The costs for any GHAD activities that occur within the boundaries of the land proposed to be annexed into the Hillcrest Heights GHAD will be covered with revenue generated through parcel assessments for the Spanish Trails Development. The proposed assessment of$1,567.17 for each of the 15 improved lots in the subdivision will be considered at the assessment ballot proceeding. REASONS FOR RECOMMENDATIONS AND BACKGROUND: On July 22, 2008, the GHAD Board conditioned approval of the annexation of the Spanish Trails Development into the Hillcrest Heights GHAD on subsequent approval of proposed parcel assessments to pay for GHAD activity to prevent mitigate and abate geologic hazards within the annexed territory. The assessment will be levied on each improved lot in the subdivision, which funding will be collected'and used in accordance with the Hillcrest Heights GHAD Plan of Control for Spanish Trails. The proposed assessment of$1,567.17 for each of the 15 improved lots in the subdivision is supported by a detailed Engineer's Report prepared by a registered professional engineer certified by the State of California, and will be considered on September 16, 2008 in accordance with Proposition 218. CONSEQUENCES OF NEGATIVE ACTION: The Board of Supervisors required the approval of the proposed assessment as a condition of approval for annexation of the Spanish Trails subdivision into the Hillcrest Heights GHAD. If the GHAD Board does not proceed with this matter, the annexation will not occur. On July 23, 1996, the Contra Costa County Board of Supervisors adopted Resolution No. 96/329, approving and ordering the formation of the Hillcrest Heights Subdivision 7582 Geologic Hazard Abatement District ("Hillcrest Heights GHAD") and appointing itself to act as the Board of Directors of the GHAD ("GHAD Board"). This formation was described in the petition dated May 8, 1996 and in the GHAD Plan of Control dated May 8, 1996. Subsequently, the GHAD Board imposed assessments on the properties within the GHAD to fund the improvement, monitoring and maintenance of improvements described in the Plan of Control. B. On June 24, 2008, the GHAD Board accepted and reviewed the Petition for Annexation of Territory to the Hillcrest Heights Geologic Hazard Abatement District ("GHAD Petition"). In connection with the proposed annexation, the GHAD Board'also accepted the proposed Hillcrest Heights GHAD Plan of Control for Spanish Trails. C. On July 22, 2008, the GHAD Board approved the annexation and adopted the Hillcrest Heights GHAD Plan of Control for Spanish Trails. Oil that same day, subsequent to the GHAD Board's approval, the Board of Supervisors approved the annexation in accordance with Public Resources.Code section 26581. Both approvals were conditioned upon subsequent approval of the proposed assessment for the Spanish Trails subdivision. In order to pay for the cost and expenses of maintaining and operating the improvements for the Hillcrest Heights GRAD, as described in the Hillcrest Heights GHAD Plan of Control for Spanish Trails, pursuant to Public Resources Code sections 26500 et seq., it will be necessary to provide for a reliable source of funding. E. Public Resources Code sections 26650 et seq. authorize, after a noticed public hearing, the levy and collection of an assessment upon specially benefited property within the GHAD to pay for the maintenance and operation of GHAD improvements. Article XIII(D) of the California Constitution imposes additional requirements for the levy and collection of said assessment. F. An Engineer's Report (attached hereto as Exhibit 1) has been prepared by a registered professional engineer certified in the State of California, in compliance with Public Resources Code section 26651(a) and section 4(b) of Article XIII(D) of the California Constitution. The Engineer's Report explains the purpose of the GHAD and provides the estimated budget, the total assessment that will be chargeable to the territory proposed to be annexed into the GRAD, the estimated assessment to be levied against each parcel within such territory, and a description of the method used in formulating the estimated assessments. THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY CALIFORNIA ACTING AS THE 'BOARD OF DIRECTORS FOR THE HILLCREST HEIGHTS GEOLOGIC HAZARD ABATEMENT DISTRICT RESOLVES AND ORDERS THAT: I. The GHAD Board declares its intention, consistent with the requirements of Article XIII(D) of the California Constitution, Public Resources Code section 26650 et. seq., Government Code section 53750 et. seq.. and Elections Code section 4000, to order that th.e cost and expenses of maintaining and operating any GHAD improvements acquired or constructed pursuant to Public Resources Code sections 26500 et. seq. shall be assessed against those parcels to be annexed to the GHAD as identified on the Boundary Map, that are specially benefited by the GHAD. 2. The GHAD Board further declares its intention to assess against those parcels shown on the Boundary Map (attached hereto as Exhibit 2) for the 08/09 fiscal year and for subsequent years, all or part of the amounts set forth in the Engineer's Report commencing the first fiscal year following issuance of a building permit for that parcel. 3. Notwithstanding Paragraph 2 above, the GHAD Board shall not order this assessment if a majority protest exists as defined in Section 4(e) of Article XIII(D) of the California Constitution. Each of the parcels identified on the Boundary Map will receive a particular and distinct special benefit in the form of GHAD improvements and services that are over and above the general benefits received by the general public. Specifically, in order to control the geologic hazards within the GHAD, the GHAD may, without limitation: (a) evaluate the performance of the natural, cut, and reconstructed slopes, the surface drainage and ditches to prevent certain geologic hazards within he GRAD; (b) perform certain temporary and permanent mitigation, repairs and improvement measures to prevent, mitigate, abate and control geologic hazards within the GHAD; (c) maintain debris benches, drainage systems and instruments such as piezometers, settlement monitors and inclinometers; (d) maintain detention ponds; and (e) establish a reserve to fund, prevent, mitigate, abate or control geologic hazards within the GRAD. These special benefits are described in detail in the Hillcrest Heights GHAD Plan of Control for Spanish Trails on file with the Contra Costa County Department of Public Works. 5. Hereafter, whenever the parcels identified on the Boundary Map are re-subdivided and a final map is approved and filed for recording with the County Recorder, each newly created residential lot will be assessed in the manner provided in the Engineer's Report. 6. The GHAD Board has reviewed and considered the Engineer's Report. The special benefit derived from the CHAD by each parcel is proportionate to the entire costs of the GRAD, and the amount of the assessment is proportional to, and no greater than, the benefits conferred on each parcel. The assessment does not exceed the reasonable costs of the proportional special benefit conferred on each parcel. 7. No later than three (3) days after the adoption of this Resolution, the GHAD Board directs the Public Works Director to mail the "Notice of Adoption of Resolution" (attached hereto as Exhibit 3) to each owner of real property (as shown on the last equalized property tax roll of the County) to be annexed to the GHAD as shown on the Boundary Map. The sealable Ballot (attached hereto as Exhibit 4) and the Engineer's Report shall be attached to the Notice of Adoption of Resolution. 8. The GHAD Board will conduct the public hearing on September 16, 2008 at 9:30 a.m., in the Board of Supervisor's Chambers, 651 Pine Street, Room 107, Martinez, California. The following paragraph provides the procedures for returning and tabulating the ballots. A copy of this Notice of Adoption of Resolution, a sealable ballot and the Engineer's Report has been sent to each of the owners of the property to be annexed to the GHAD. The Ballot may be completed and mailed or hand delivered to the Puublic Works Department, Attn: Warren Lai, 255 Glacier Drive, Martinez, California, 94553,. or may be submitted at the public hearing. The Ballot may be withdrawn or changed at any time prior to the conclusion of the public testimony on the proposed assessment at the public hearing. At the hearing, the GHAD Board shall consider any objections or protests to the assessment and certify the tabulation of the ballots. The GHAD Board shall not impose the assessment if there is a majority protest. A majority protest exists if, upon the conclusion of the hearing, ballots submitted in opposition to the assessment exceed the ballots submitted in favor of the assessment. In tabulating the ballots, the ballots shall be weighted according to the proportional financial obligation of the affected property. 9. Following the public hearing, the GHAD Board shall consider the adoption of the canvas of votes for the GHAD. 10. Upon authorization of the assessment, the GHAD Board shall levy the authorized assessment on each parcel the first fiscal year following issuance of a building permit for each parcel. 11. This Resolution shall become effective immediately upon its passage and adoption. The GHAD is intended to provide geologic hazard improvements for the Spanish Trails subdivision and to levy and collect assessments sufficient to pay for those improvements. The improvements to the Spanish Trails subdivision that are the subject of this report are defined as any activity necessary or incidental in the prevention, mitigation, abatement or control of a geologic hazard, construction., maintenance, repair, or operation of any improvement; or the issuance and servicing of bonds issued to finance any.of the forgoing. INTRODUCTION The Hillcrest Heights Geologic Hazard Abatement District ("GHAD or "District") was formed under the authority of the California Public Resources Code, Division 17, Section 26500 el.seg. II. BACKGROUND The County of Contra Costa Board of Supervisors adopted Resolution No. 96/329 on July 23, 1996, approving the formation of the Hillcrest Heights Subdivision 7582 Geologic Hazard Abatement District ("Hillcrest Heights GHAD"). The Board of Supervisors, acting as the Board of Directors of the Hillcrest Heights GHAD, adopted Resolution No. 2008/ on 2008, approving the annexation of the Spanish Trails subdivision to the Hillcrest Heights GHAD. Under Public Resources Code section 26581, the Board of Supervisors then adopted Resolution No. 2008/ on , 2008, approving the annexation of the Spanish Trails subdivision to the Hillcrest Heights GHAD. III. GEOLOGIC HAZARD ABATEMENT DISTRICT BOUNDARIES The boundaries for the Spanish Trails subdivision are shown in the diagram attached hereto as Exhibit A. TERRASE.ARCH,hic. SERVICE LEVELS The Hillcrest Heights GHAD provides for activity that is necessary or incidental to the prevention, mitigation, abatement, or control of geologic hazards including construction, maintenance, repair, or operation of any improvement, and the issuance and servicing of bonds issued to finance any of the foregoing. The Hillcrest Heights GHAD provides for the administration and review of facilities within budgeted limits and including the following services: 1. Oversight of GHAD activities. 2. In conjunction with the County Assessor's Office, setting the. annual levy ol' assessments on the property tax rolls. 3. Retention of geotechnical professionals to perform the monitoring duties described in the GHAD Plan Control for Spanish Trails. 4. Performance of GHAD maintenance activities in accordance with the Hillcrest Heights GHAD Plan of Control for Spanish Trails. These maintenance activities include: • Lined surface drainage ditches. .• Storm drain inlet, outfalls and pipelines within common areas. Subdrains. • Retaining wall and appurtenant drainage facility maintenance. • Debris wall maintenance. • Erosion management. 5. Slope reconstruction 6. Preparation of annual GHAD budgets. V. DESCRIPTION OF THE GHAD IMPROVEMENTS The GHAD improvements are described in the Hillcrest Heights GHAD Plan of Control for Spanish Trails, dated 27 May 2008. In general, improvements include drainage systems (including concrete v-ditches in open space, open-space storm drain inlets and outlets and TERRASEARCH,inc.. Page 6 of 17 Project No.6034.63 Engineers Report/Spanish Trails 27 May 2008 subdrains), debris wall, retaining walls with appurtenant drainage systems, natural slopes and reconstructed slopes and any improvements constructed by the homeowner after the builder has constructed a house on the lot, that are accepted by the GHAD. Vl. ASSESSMENT METHOD The improvements referenced' in.Section V are distributed within the boundaries of the Spanish Trails subdivision. The District Engineer hereby finds that the properties within the Spanish Trails subdivision receive approximately equal special benefit from the work and improvements of the Hillcrest Heights GHAD. Maintenance and protection of these improvements provide a special benefit to all of the real property within the subdivision. As a result, the assessment is distributed equally among all of the properties annexed to the Hillcrest Heights GHAD. The total number of residential units within the Spanish Trails subdivision is divided into the annual GHAD budget to develop the annual assessment amount. A financial analysis was performed to provide a framework for an operating budget for the on-going abatement, mitioation, prevention and control of geologic hazards within the Spanish Trails subdivision. In preparation of the budget, several factors were considered including: • Site geology. • Proposed remedial grading. • Proximity of geologic hazards to proposed residences. • Site access considerations. • Elements requiring routine maintenance including: 1. Surface drainage facilities I Graded and natural slopes 3. Storm drain inlets, outfalls and pipelines within common areas 4. Retaining wall and appurtenant drainage facility maintenance 5. ASSESSMENT LIMIT-BUDGET Upon annexation of the Spanish Trails subdivision to the Hillcrest Heights GHAD, the District will be funded by property tax assessments levied upon each lot within the boundaries of the subdivision. The assessment shall be levied on each individual parcel. Grading and construction of all improvements has been completed. The First building permit was issued in July 2007. It is our understanding that the developer will pay $100,000 once the GHAD improvements have been accepted or 3 years after the assessment has been confirmed, whichever happens first. A.summary bud(7et was prepared for the purpose of estimating initial assessment levels and is attached as Exhibit B. In order to establish a reasonable reserve .:in the early years following formation of the GHAD, there will be an initial deferral of GHADexpenses as described in the Plan of Control. Administrative Costs The possible repair and maintenance budget costs for the Hillcrest Heights Subdivision 7582 are unique to that subdivision and were not considered in our review. However, the administrative costs for the Hillcrest Heights GHAD were considered relevant and are used for this .budget. Since the Spanish Trails subdivision.will be annexed into the existing Hillcrest Heights GHAD, the administration is in place and there will be some additional administration associated with the Spanish Trails subdivision. It is anticipated that the additional administration costs associated with the Spanish Trails subdivision will be lower than those currently in place for the Hillcrest Heights Subdivision 7582. We have applied an additional administrative cost of 30% more than the current yearly budget, as set forth below: General Manager $5,000.00 County Public Works Personnel $1,500.00 Legal & Accounting $ 500.00 TERR FSE.t RCH,inn. Page 8 of 17 Project No.6034.63 Engineers Report/Spanish"rrails 27 May 2008 GFIAD Association Membership $7.50 (existing membership) TOTAL YEARLY ADMINISTRATION BUDGET $7,007.50 Monitoring and Maintenance Costs Based on the frequency of monitoring outlined in the Hillcrest Heights GHAD Plan of Control for Spanish Trails, the cost for administrating, performing the monitoring and minor cleaning and/or grouting and preparation of a report for one year without any major repairs is estimated to be $8,700.per year and is itemized as follows: I. Coordination $ 500 2. Average flour site visits per year(4 visits nw, 4 hrs/visit @ $160/hr) $ 2,560 3. Contractor(most likely required for small repair and cleaning items At most one time per year—estimate $ 4,000 4. Follow up observation of repair/cleaning work 1 visit @ 4 hours @ $160/hr $ 640 5. Once a large scale slide is repaired the likelihood of future instabilities would decrease as a large area of the slope would have been repaired. Deducting the $100,000 initiallypaid into the reserve, the remaining cost to be assessed is $1,175,375 over 50y ears. This is equivalent to $23,505.50 per year for all 15 lots and equates to an assessment of$1,567.17 per lot per year. This formation was described in the petition dated May 8, 1996.and in the GRAD Plan of Control dated May 8, 1996. Subsequently, the GHAD Board imposed assessments on the properties within the CHAD to fund the improvement, monitoring and maintenance of improvements described in the Plan of Control. These actions were taken in accordance with Public Resources Code sections 26500 et seq. for.the purpose of the prevention, mitigation, abatement and control of certain geologic hazards. Due to the potential for land sliding, the Conditions of Approval for the Spanish Trails Development (DP 03-3052, SD 02-8687) require the annexation into the existing Hillcrest .Heights GRAD, or the creation of a new independent GRAD, prior,to issuance of the first building permit. To satisfy these requirements, the developer of the Spanish Trails subdivision elected to petition the Board of Directors of the Hillcrest Heights CHAD ("GHAD Board") to annex the subdivision into that existing GHAD. The boundaries of the Spanish Trails subdivision are not contiguous with the boundaries of the 66 unit Hillcrest Heights Subdivision 7582 that is already part of the Hillcrest Heights GHAD. On July 22, 2008, the GHAD Board approved the annexation and adopted the Hillcrest Heights GHAD Plan of Control for Spanish Trails. On that same day, subsequent to the GHAD Board's approval, the Board of Supervisors approved the annexation in accordance with Public Resources Code section 26581. The Hillcrest Heights GRAD provides for the administration and review of facilities within budgeted limits and including the following services: 1. Oversight of GHAD activities. 2. In conjunction with the County Assessor's Office, setting the annual levy of assessments on the property tax rolls. 3. Retention of geotechnical professionals to perform the monitoring duties described in the GHAD Plan Control for Spanish Trails. 4. Performance of GHAD maintenance activities in accordance with the Hillcrest Heights CHAD Plan of Control for Spanish 'Trails. V1. ASSESSMENT METHOD The improvements referenced in Section V are distributed within the boundaries of the Spanish Trails subdivision. The District Engineer hereby Ends that the properties within the Spanish Trails subdivision receive approximately equal special benefit from the work and improvements of the Hillcrest Heights GRAD. Maintenance and protection of these improvements provide a special benefit to all of the real property within the subdivision. As a result, the assessment is distributed equally among all of the properties annexed to the Hillcrest Heights GRAD. The total number of residential units within the Spanish Trails subdivision is divided into the annual GRAD budget to develop the annual assessment amount. A financial analysis was performed to provide a framework for an operating budget for the on-going abatement, mitigation, prevention and control of geologic hazards within the Spanish Trails subdivision. ASSESSMENT LIMIT-BUDGET Upon annexation of the Spanish Trails subdivision to the Hillcrest Heights GHAD, the District will be funded by property tax assessments levied upon each lot within the boundaries of the subdivision. The assessment shall be levied on each individual parcel. Grading and construction of all improvements has been completed. The first building permit was issued in July 2007. The GHAD improvements shall become eligible for transfer to the GHAD 5 years after the assessment has been confirmed. A stunmary budget was prepared for the purpose of estimating initial assessment levels and is attached as Exhibit B. In order to establish a reasonable reserve in the early years following formation of the GHAD, there will be an initial deferral of GIIAD expenses as described in the Plan of Control. Administrative Costs, The possible repair and maintenance budget costs for the Hillcrest Heights Subdivision 7582 are unique to that subdivision and were not considered in our review.. However, the administrative costs for the Hillcrest Heights GHAD were considered relevant and are used for this budget. Since the Spanish Trails subdivision will be annexed into the existing Hillcrest Heights GHAD, the administration is in place and there will be some additional administration associated with the Spanish Trails subdivision. It is anticipated that the additional administration costs associated with the Spanish Trails subdivision will be lower than those currently in place for the Hillcrest Heights Subdivision 7582. Once a large scale slide is repaired the likelihood of future instabilities would decrease as a large area of the slope would have been repaired. Based on 2008 dollars, the .expected total cost over the next 50 years including total administrative costs plus total yearly monitoring and maintenance costs plus the total of major repairs, is estimated to be $1,275,375 (50 years x $7007.50 - 50 years x $8,700 + $490,000). The $1,275,375 cost spread over 50 years is equivalent to $25,507.50 per year for all 15 lots and equates to an assessment of $1,700.50per lot per year. Accordingly, the District Engineer recommends an annual assessment limit of $1,700.50 per residential unit to be levied upon the completion of the annexation process. This limit will escalate annually based on San Francisco-Oakland San Jose Consumer Price Index.
