Walker, M.D., Director _ Costa DATE: July 22, 2008 Count SUBJECT: Application: License to Operate A Driving-Under-the-Influence Program SPECIFIC REQUEST(S)OR RECOMMENDATION(S)8 BACKGROUND AND JUSTIFICATION RECOMMENDATION: The Contra Costa County Board of Supervisors (BOS) recommends to the State Department of Alcohol and Drug Programs, through the County Alcohol and Other Drug (AOD) Administrator, that a license be granted to Bi-Rett, Inc. doing business as (dba) Pueblo Del Sol to operate an English and Spanish language First and Multiple Offender Driving-Under-the- Influence (DUI) Program in the Brentwood area. BACKGROUND: The ACID Administrator has determined that a DUI Program is required in East County due to an increase in population, and to better serve the residents in the City of Brentwood and the surrounding vicinity. This determination was made by conducting an assessment of the number of clients that are required to drive from Brentwood to the nearest program to receive DUI services. It was found that at least thirty percent of clients from the area are commuting more than 15 miles to Pittsburg to attend a program. This distance creates a public safety issue as many of the DUI clients lose their license for a minimum of 30 days to 12 months, and are required to attend a DUI program to reinstate their driver's license and meet Court requirements. A DUI Program in Brentwood would provide greater access to services for residents of Brentwood and the surrounding area to meet DMV/Court requirements. Therefore, Bi-Bett, Inc., dba Pueblo Del SOI has submitted an application for licensure. A review of the application indicates Bi-Rett, Inc. meets statutory and regulatory requirements set forth in the Health and Safety Code, Section 11836 and Title 9, Section 9804. A second requirement under Title 9, Section 9801.5(a)(1) requires the BOS include a statement assuring a need exists, and that the establishment of a new DUI Program will not jeopardize the fiscal integrity of an existing licensed program. As stated above, the criteria has been met to license an additional DUI Program, and as Bi-Bett, Inc. currently operates the DUI Program in Pittsburg, licensure of Brentwood will not jeopardize the fiscal integrity of their existing program. Finally, Title 9, Section 9805(a)(2) requires a County Alcohol Advisory Board recommendation, if the county has an alcohol advisory board. Therefore, this document has gone before the Alcohol Advisory Board on May 28, 2008, and the Advisory Board supports licensure of Bi- Bett, Inc. for first and multiple offender services (see enclosed recommendation). There are no County General Fund costs associated with this recommendation and there is no opposition to Bi-Bett's licensure. This determination was made by conducting a needs assessment. The assessment indicated that a number of clients are required to drive from Brentwood to the nearest program to receive DUI Program services. It was found that at least thirty percent of clients are required to commute more than 15 miles to Pittsburg to attend a program. This distance creates a public safety issue for many of the DUI clients that have lost their license for a minimum of 30 days to 12 months. A DUI Program in Brentwood would provide greater access to services for residents of Brentwood and the surrounding area to meet the Department of Motor Vehicles and Court requirements. The licensure of a program in Brentwood will not negatively impact the closest DUI Program (Dawn Center), as Bi-Belt Corporation operates the Dawn Center. Based on the needs assessment, in April of 2006, Contra Costa Alcohol and Other Drug Services issued a letter accepting Bi-Belt Corporation's application to open a licensed DUI Program in Brentwood. Although this has been a lengthy process, a final review of the application indicates Bi-Belt, Inc. has met all statutory and regulatory requirements as set forth in the Health and Safety Code, Section 11836 and Title 9, Section 9804. Therefore, this matter will be scheduled on the Consent Agenda for the Board of Supervisors (BOS) to review in June 2008. However, pursuant to Title 9, Section 9805(a)(2), one of the roles of the Alcohol and Other Drugs Advisory Board is to review and make a recommendation on the application for licensure to the BOS, as a condition of licensure. Additionally, Title 9, Section 9801.5(a) requires the County AOD Administrator also make a recommendation.
