(District II & IV) (Drainage Area Zone 3B Funds) Project No.7520-6B8345-07 SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: APPROVE and AUTHORIZE the Public Works Director, or designee, to execute Amendment No. 1 to an existing Consulting Services Agreement with Harris and Associates, Inc. effective September 18, 2007, update Appendix B for the additional and modified wage rates, and to increase the payment limit by $280,000 to a new payment limit of $480,000 with no change to the contract dates in order to provide construction management services for the Lower Walnut Creek Interim Protection Project in the Walnut Creek area. FISCAL IMPACT: This contract amendment allows for an additional $280,000 (100% Drainage Area Zone 3B Funds) above the previously approved contract for $200,000. There is no impact to the General Fund. Dowling,Construction Contractor SUBJECT: Amendment No. 1 to the On-Call Consulting Services Agreement with Harris and Associates, Inc. (District II & IV) (Drainage Area Zone 3B Funds) DATE: September 18, 2007 PAGE: 2 of 2 REASONS FOR RECOMMENDATIONS AND BACKGROUND: On April 10, 2007, the Board of Supervisors declared an emergency and authorized the Chief Engineer, Flood Control and Water Conservation District, to proceed in the most expeditious manner for the Lower Walnut Creek Interim Protection Measures project. An emergency declaration was necessary in order to immediately address the potential flooding risk and take corrective action within the one-year period prescribed by the U.S, Army Corps of Engineers (see ITEM C.71 on April 10, 2007 for further details). Public Works immediately began the design process to prepare construction plans, specifications and estimates for the Lower Walnut Creek Interim Protection Measures project. On August 7, 2007, the Public Works Department opened bids for the project. The contract was awarded to Pacific States Environmental Contractors, Inc. in the amount of $2,802,888.20. Currently, Public Works has a consulting services agreement with Harris and Associates, Inc. for construction management services in order to meet the schedules for various County projects on an as needed basis. Staff selected Harris and Associates, Inc. through the standard consultant selection process of requesting proposals, selecting the top proposals for interviews, interviewing the top candidates, and then entering into an agreement. Due to the emergency nature of the project, Public Works has already begun using Harris and Associates, Inc. to assist in awarding the project and performing construction management duties for the project. The current Consulting Services Agreement has monies remaining but we are recommending the addition of $280,000 to the agreement. This value represents the anticipated cost to provide construction management services for this project. The existing consulting services agreement with Harris and Associates, Inc. was established in June of 2007. As a part of this amendment we have updated the rate schedule (Appendix B of the contract) to reflect additional job titles and salaries as required for this project. CONSEQUENCES OF NEGATIVE ACTION: If the amendment is not approved, the design of the Lower Walnut Creek Interim Protection Project will be delayed. AMENDMENT No. 1 ON-CALL CONSULTING SERVICES AGREEMENT Harris and Associates, Inc. 1. Parties: Effective on June 26, 2007, the County of Contra Costa, a political subdivision of the State of California, hereinafter referred to as "Public Agency," and Harris and Associates, Inc., hereinafter referred to as "Consultant," mutually agree and promise as follows: A. To increase contract payment limits by $280,000. $280,000 for the Lower Walnut Creek Interim Protection Measure Project 2. Purpose: The parties desire to amend the agreement they entered into effective June 5, 2007, entitled "On- Call Civil Engineering Consulting Services Agreement," hereinafter referred to as the "Agreement." The Agreement is to provide construction management and inspection services on an on-call basis for Public Works staff. This amendment is necessary to reimburse the Consultant for expected work beyond the original limits of the existing On-Call Consulting Services Agreement. 3. Amendment(s) to Agreement: Amend Section 1(e): Agreement Payment Limits to $480,000: Amend Appendix B: Rate Schedule (attached and valid until April 30, 2009) to include a new position: Project Director at an hourly rate of$180 and modify the Senior Inspector hourly rate to $125. 4. Remaining Provisions: Except for the changes made by this Amendment, all provisions of the Agreement shall remain in full force and effect. 5.
