RECOMMENDATION(S):
ADOPT Resolution No. 2007/ for Subdivision 02-08646,accepting completion of improvements,for project
being developed by Western Pacific Housing, Inc., San Ramon (Dougherty Valley) area. (District III)
FISCAL IMPACT:
None.
BACKGROUND/REASON(S) FOR RECOMMENDATION(S):
The developer, Western Pacific Housing, Inc., has completed the subdivision improvements per the Subdivision
Agreement, and in accordance with the Title 9 of the County Ordinance Code.
CONSEQUENCES OF NEGATIVE ACTION:
The completion of improvements will not be accepted and the warranty period will not begin.

SUBJECT: Accepting completion of improvements, Subdivision 02-08646, for project being
developed by Western Pacific Housing, Inc., San Ramon (Dougherty Valley) area.

These improvements are approximately located near Bollinger Canyon Road and Albion
Road.
The Public Works Director has notified this Board that the private improvements in
Subdivision 02-08646 have been completed as provided in the Subdivision Agreement with Western
Pacific Housing, Inc., heretofore approved by this Board in conjunction with the filing of the
Subdivision Map.

SUBJECT: Accepting completion of improvements, Subdivision 02-08646, for project being
developed by Western Pacific Housing, Inc., San Ramon (Dougherty Valley) area.

NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED
as of August 14, 2007 thereby establishing the six-month terminal period for the filing of liens in
case of action under said Subdivision Agreement:

BE IT FURTHER RESOLVED the payment (labor and materials) surety for$641,950.00,
Bond No. 6187284 issued by the above surety be RETAINED for the six month lien guarantee
period until February 14, 2008, at which time the Clerk of the Board is AUTHORIZED to release
the surety less the amount of any claims on file.
BE IT FURTHER RESOLVED that Glenmark Way,Tarada Lane,Arianna Lane,Joree Lane,
Nancy Lance,and Soren Way for the hereinafter described private roads,as shown and dedicated for
private use on the Final Map of Subdivision 02-08646 filed January 17, 2003, in Book 451 of final
maps at Page 3 Official Records of Contra Costa County, State of California, have been
COMPLETED and are NOT ACCEPTED, at this time.

Upon acceptance by the Board of Supervisors,the Homeowner Association shall accept
the following Gleninore Way, Tarada Lane, Arianna Lane, Joree Lane, Nancy Lane, and Soren
Way for maintenance and ownership.
BE IT FURTHER RESOLVED that there is no warranty period required, and the Public
Works Director is AUTHORIZED to refund the $12,900.00 cash security for performance
(Auditor's Deposit Permit No. 395897,dated November 13,2002)plus interest in accordance with
Government Code Scction 53079, if appropriate, to Western Pacific Housing, pursuant to the
requirements of the Ordinance Code; and the Subdivision Agreement and surety bond, Bond No.
6187284, dated November 5, 2002 are exonerated.
All deposit permits are on file with the Public Works Department.
