DECLARE that this Board will meet on September 11,2007 at 9:30 a.m.or thereafter,in the Board's Chambers, County Administration Building,Martinez,California,to consummate this conveyance by a four-fifths vote and the Clerk of this Board is DIRECTED to publish the attached notice in the Contra Costa Times pursuant to Government Code Section 6061. FISCAL IMPACT: The Bypass Authority will pay the Flood Control District $796,500.00 for the above real property rights upon consummation of the sale. REASONS FOR RECOMMENDATIONS AND BACKGROUND: These property rights are required for the State Route 4 Bypass-Laurel Road Extension project in accordance with approved plans and specifications. Because the State Route 4 Bypass Authority has the power of eminent domain the real property transaction is exempt from CEQA. CONSEQUENCES OF NEGATIVE ACTION: If the Flood Control District were not to convey these property rights,the project will not have sufficient land rights to allow construction in accordance with the approved plans and specifications.
