SPECIFIC RI QUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: APPROVE the Public Works Director's recommendation to terminate the Cooperative Agreement between the County and Shell Oil Products US (Shell Oil Company) effective August 14, 2007 and AUTHORIZE the Public Works Director to return to Shell Oil Products US the unexpended deposited funds, approximately $157,800. FISCAL IMPACT: No impact to the County General or Road Funds. DATE: August 14, 2007 PAGE: 2 of 2 REASONS FOR RECOMMENDATIONS AND BACKGROUND: Shell Oil was granted a land use permit(LUP2009-92)in 1993 for their"Clean Fuels Project". This permit required Shell Oil to design and construct various frontage improvements on County roads surrounding their Martinez refinery. The County entered into a cooperative agreement on November 8, 1994 to design and construct these improvements. Subsequently the County designed and constructed improvements on Pacheco Boulevard and Shell Avenue in conformance with the Cooperative Agreement. The Cooperative Agreement requires mutual consent for the agreement to terminate. Shell Oil has requested on July 23, 2007 the Cooperative Agreement be terminated and remaining funds returned. The Public Works Director concurs with Shell Oil and recommends the Board of Supervisors approve the termination of this Cooperative Agreement. Terminating this agreement has no impact on any remaining obligations of Shell Oil under the land use permits.
