If the Board determines that the terms of one or both of the regional commissions should be extended, DIRECT the Community Development Department and the Office of County Council to prepare an ordinance and schedule the item for the Board's decision. II. BACKGROUND The seven member San Ramon Valley Regional Planning Commission and the five member East County Regional Planning Commission were established in 1986. The County Code provides that the sections establishing the regional commissions are automatically repealed beginning on October 7, 2007 unless the Board otherwise provides before then (see Attachment A). The County Planning Commission calendared a discussion of this issue at their February 27, 2007 meeting. The Commission voted unanimously to recommend that the Board decline to extend the San Ramon Valley Regional Planning Commission. With respect.to the East County Regional Planning ;Commission, the motion was to recommend that the Board "consider" whether the term of the Commission should be extended. The County Planning Commission and the San Ramon Valley Regional Planning Commission were informed, at their most recent meetings, that this item would be on the Board's July 24, 2007 agenda. A copy of this Board Order has been provided to the members of all planning commissions. 2e ADDENDUM TO D.2 July 24, 2007 On this day the Board of Supervisors considered a recommendation of the County Planning Commission regarding the,extensions of the San Ramon Valley (SRVPC) and East County Regional Planning Commissions, (ECRPC) and-consider action to be taken. Catherine Kutsuris, Deputy Director, Community Development Department (CDD) introduced the item, noting that the SRVPC and ECRPC will sunset on October 7, 2007. and requesting the Board consider an extension. Chair Piepho said the item before the Board does not have a lot of background information other than the County Planning Commission's recommendation. She said further discussions need to take place before the Board takes an action. Supervisor Glover said he supports Chair Piepho's request for more information. He!said much growth is still taking place within East County and there are opportunities for local representatives to look at those projects. Supervisor Gioia asked CDD staff to include in the report the populations for Alamo: Blackhawk, Diablo,Bay Point, Bethel Island, Byron, Discovery Bay and Knightsen., He also requested potential caseloads from these areas and the reason to continue the term of one or both of the regional commissions. He said there is also an equity issue and said it is important to look at all areas in the County to see if issues remain. Dennis Barry, Community Development Director, said that would normally be staff's recommendation but we have an ordinance that will sunset. Supervisor Bonilla noted the Internal Operations Committee is evaluating all the commissions and boards to see how they function in their duties, and suggested the Board could both address this issue now and also direct further review as part of the IOC's evaluations. Ms. Kutsuris said the last date for Board action would be October 2, 2007, at which time an Urgency Ordinance could be adopted. She suggested returning to the Board in September, which would allow time to for both regional commissions to place the matter on their agendas for discussion. Chair Piepho requested CDD staff include in their report the Planning Commission's discussions. Supervisor Gioia asked when the SRVPC and ECRPC were formed, what the unincorporated communities were at the time they were formed, the changes; if any; since the formation, the current unincorporated communities population and history on the nature of the kinds of cases and matters heard by the commissions. l 3 Supervisor Glover said he supports making sure there is an opportunity for the SRVPC and ECPC to put the matter on their agendas for discussion and return to the Board with their comments. Supervisor Uilkema said the current and projected workloads need to be discussed to find out whether this is a relief valve for the County Planning.Commission, and also said the approximate cost to maintain the commissions should be discussed. Chair Piepho called for public comment.and the following people spoke: ■ Neal Matsunaga, Chair, SRVPC, told the Board the regional commission provides a vehicle for input and serves a purpose for being able to spend time on issues. He said his opinion of workload costs is relatively small. He said the County Planning Commission is spread out across a broader area and noted there is something to be said for people who are paying attention to the local issues and are familiar with the local issues. He said the workload has diminished significantly but noted that Dougherty Valley is still in a buildout phase. He said there is a place for the SRVPC given that the costs are relatively small. Supervisor Gioia suggested looking at equity around the County, noting that the richest parts seem to want their own planning committee. Iie commented on the perception that lower income areas do not have that kind of structure. Supervisor Uilkema suggested it would be useful to note on a map the areas where future planning decisions need to be made. ■ Mike Gibson, Alamo resident, spoke in favor of reauthorizing the SRVPC. He said regional commissions review things of regional significance, and said it is unfortunate that only two of the four regions have regional planning commissions. ■ Maryann Cella, past Chairperson, Diablo Municipal Advisory Council, said and agrees that more information is needed. She handed a copy of a resolution passed by the Diablo Municipal Advisory Council supporting the extension of the charter. She said given the large area and high traffic congestion in the County, local regional planning commissions give residents an easier way to make their voices heard. ■ Smitty Schmidt, Alamo resident, requested the Board to put this matter off until there is some community input. . ■ Robert Oliver, Alamo resident, said his feeling on the SRVPC is "If it ain't broke don't tr'y to fix it. ■ Brad Waite, President, Alamo Improvement Association, said he appreciates the Board's comments about the need to continue this matter to a future date. He said there might only be sporadic items before the SRVPC but that does not decrease the importance of giving them a thorough and local review with the citizens. ■ Roger Smith, Chairman, Alamo Improvement Association, said the SRVPC'is a good system that has provided benefit to the residents of Alamo at the county and 2 W local level. He said this process works in a comprehensive and cohesive way, which has increased the value of property and the quality of life. The following person did not wish to speak but left written comment for consideration: ■ Diablo Community Services District, opposing the sunseting of the SRVPC; ■ Vince Chow, Diablo Property Owners Association, said the DPA requests deferment of any final decisions until further community input can be heard. The following Alamo residents submitted e-mail on this item opposing the elimination of the SRVPC; ■ John Marrone; ■ Steve and Barbara Ross; ■ Jeff and Heidi Abramson; ■ Kim Edmondson; ■ Cassandra Marrone; ■ Norma Schiller; ■ Dr. Hillary Jon Lerner; ■ Barbara Musante; ■ Loren Barr; ■ Calvin and Kathryne Tucker; ■ Jeanne Tate; ■ Daniel Fay; ■ JoAnn Jacobson; ■ Fernando Olivas; ■ Anonymous; ■ Alice Gomez; ■ Anonymous; ■ Jack Russ; ■ Martha Kirsch; and ■ Rick Elfman Chair Piepho asked Ms. Kutsuris why Dougherty Valley did not come before the SRVPC. Ms. Kutsuris she said the County Code includes significant flexibility for the Board to assign projects of regional interest, and explained when there are projects of that magnitude CDD brings them to the Board for a formal discussion of what would be' preferred and in this case the Board determined the Dougherty Valley's official hearing body should be the County Planning Commission. Supervisor Gioia added that the reason all these committees have a sunset date is that they were meant to be re-evaluated. POSTPONED a final decision on the matter of extensions of the San Ramon Valley Planning Commission and the East County Regional Planning Commission; REQUESTED that both.the Commissions list the matter on upcoming agendas in order to provide the Board with their input; REQUESTED that the Community Development Department work with the District III office to solicit input from the cities of Danville and San Ramon; and REQUESTED that Community Development Department staff return to the Board at a future date with the following information: r ■ Historical data regarding the difference between when the regional commissions were established and today (e.g. population, unincorporated area), including a comparison with the west county area; ■ Current and projected workloads of the regional commissions; ■ An evaluation of whether the regional commissions provide a relief valve for the County Planning Commission; ■ Costs associated with operating the regional commissions; ■ Differences in growth for the areas; ■ Information from the regional commissions on their perspective of upcoming' workload; ■ Any additional information from the County Planning Commission particularly with respect to their recommendations for the regional commissions; 4 RESOLUTION NO. 1.3-2007 RESOLUTION OF THE COUNTY PLANNING COMMISSION OF THE COUNTY OF CONTRA COSTA, STATE OF CALIFORNIA, RECOMMENDING THAT THE BOARD OF SUPERVISORS DECLINE TO EXTEND THE TERM OF THE SAN RAMON VALLEY REGIONAL PLANNING COMMISSION AND TO CONSIDER WHETHER THE TERM OF THE EAST COUNTY REGIONAL PLANNING COMMISSION SHOULD BE EXTENDED WHEREAS,the County.Planning Commission on Tuesday,February 27,2007,discussed the issue of whether the term of the San Ramon Valley Regional Planning Commission should be extended beyond the October 7, 2007 sunset date; and WHEREAS, the majority of the Commission meetings during the past several years have been cancelled due to the lack of planning items in the area; and WHEREAS,with the decrease of large development projects,there is no longer a need for a regional planning commission in the San Ramon Valley area; and WHEREAS, the County Planning Commission can absorb hearing items from the area that would have been handled by the San Ramon Valley Regional Planning Commission, and WHEREAS,the Commission discussed and recommended to the Board of Supervisors that they consider whether the terns for the East County Regional Planning Commission should be extended; NOW THEREFORE BE IT RESOLVED that the County Planning Commission recommends to the Board of Supervisors that the Board does not extend the term of the San Ramon Valley Regional Planning Commission, and that the Board consider whether to extend the East County Regional Planning Commission. C Of /VI 14 0+__-1;; DIABLO MUNICIPAL ADVISORY COUNCIL MEETING May 3, 2007 Minutes "DA DMAC Members present: Ray Brant, Boyd Burnison, Jim Stone and Kathy Torru DPOA Representative: none DHPC Representative: None DCSD Representative: None CCC Sheriff: None CCC Supervisors' Office: None Public Members present:.Mark Molinar, Rich Rathbun, John Leffingwell, Gail Happel, Maryann Cella Public Input—None 1879 El Nido (Richard and Kim Rathbun)—Mark Molinar, Architect, presented plans to add 1,375 feet to the existing residence. The addition will require peers under the.drip line of a 40"Valley Oak tree. The Board unanimously approved the original plans in October 2005 contingent upon certain conditions being met to protect the Valley Oak. John Leffingwell, arborist, requested that the Board amend the tree permit letter issued in October 2005. Mr. Leffingwell argued that it was impossible to hand dig peer holes 10 feet deep and 18 inches wide with a hand held auger. Mr. Leffingwell also requested that the requirement to place a 6-foot high construction fence around the Valley Oak drip line be modified to allow entrance on the cement pathway, which is under the drip line. The Board unanimously agreed to modify the letter to allow for either a tripod or a light weight vehicle to be used to dig the holes. Wood chips will be laid down in the path of the vehicle. The Board unanimously agreed to modify the fence requirement to allow the cement path to be used for foot traffic. A 6-foot chain link fence must be placed on either side of the path around the drip line of the Valley Oak. John Leffingwell requested the tree permit be expanded to allow the removal of 2 redwood trees growing under the drip line of the Valley Oak. The Board unanimously recommended that the County approve the modifications to the tree permit. This approval is contingent on no adverse comments from the neighbors during the comment period. Ray Brant will write the letter and Kathy Torru will modify the tree permit. 1850 Alameda Diablo (Bert and Barbara Barstad)—The Board received notification from the County that a variance had been requested by the Barstad's to build a second garage 6 feet from the property line. The Barstad' did not attend the meeting. Based on the material presented by the County the Board unanimously voted to deny the variance request. Boyd Burnison will write the letter g 2362 Caballo Ranchero Drive (David and Gail Happel)—Gail Happel presented plans to remove 2 pine trees and a Liquid Amber. The Board requested that as arborist report be obtained for the trees. DMAC Merger with DCSD and appointment of DMAC alternate member—The merger request has been given to LAFCO for review and approval. Appointment of an alternate Qad_naenab_e�has-been postponed at the request of Mar_y_P_ie ho'�oce. San Ramon Valley Planning Commission Charter Renewal—Maryann Cella presented a letter from Mary Piepho stating the Board of Supervisors' intent to allow,the \ San Ramon Valley Planning Commission charter to expire in October 2007. The Board \� will write a letter to Mary Piepho and the other Supervisors requesting that the SRV Planning Commission charter be renewed. Respectfully Submitted, Kathy Torru, Secretary g I I SPEECH IN SUPPORT OF EXTENDING THE SAN RAMON PLANNING COMMISSION CHARTER 1 am Maryann Cella, an attorney and immediate past Chairperson of the Diablo Municipal Advisory Council. 1 was Chairperson for 6 years, and a Councilmember for an additional 4 years. I am speaking today on behalf of myself as a 16-year Diablo resident and on behalf of my family in support of extending the charter of the SRV Planning Commission. I also have with me a copy of a resolution passed by the Diablo Municipal AdvisoryCouncil supporting an extension of the SRV Planning Commission's charter. The other governmental body in Diablo, the'!Diablo Community Services District, has also passed a resolution in support of renewing the SRValley Planning Commission's charter. Additionally, the Diablo Property Owners' Association has voted to support the continuance of the SRValley Planning Commission. There are three primary reasons for extending the charter: 1. First, the SRV Planning Commission gives the residents of the SRValley a greater voice in development matters in the area. The SRV Planning Commission is composed entirely of residents of the SRValley. In contrast, the County Planning Commission can never have even a simple majority of its members from the SRValley. Furth ernrore,.the meetings of the SRValley Planning Commission are much more convenient for the residents of the SRValley to attend. Going to meetings in Martinez is very inconvenient for residents of our valley. Many more residents would be in attendence today if this meeting were being held locally. Sone might suggest mitigating the inconvenience problem by having meetings of the County Planning Commission be held in the SRValley occasionally. Wouldn't doing that eliminate the cost savings that are one of the reasons being put forth as a basis for dissolving the SRValley Planning Comrnission? 2. Second, there still is work to be done by the San Rai-non Valley Planning Commission. There are still appeals regarding variances, small lot reviews, tree pennits, and other such matters that will always be best reviewed by the local San Ramon Valley Planning Commission. Moreover, there are still areas of undeveloped land that could be developed.in the future. For example, there is a large parcel of ridgeline land in Diablo that could potentially support 10 or more horfies. 3. Third, there arc no public bodies in.the SRValley in support of the dissolution of the ; SRValley Planning Commission. I believe that the vast majority of residents of the SRValley support the continuance of the SRValley Planning Commission. I ask Supervisor Piepho in particular as the representative of the SRValley on the Board of Supervisors to protect ouir interests and extend the Commission's charter. At the very least, the Board should today delay its decision on this matter until notice can be given more widely in the San Ramon Valley and hearings can be held locally in the SRValley. I am writing to ask that this decision not be made for at least a week or two, to allow for proper notification of affected residents. The SRVPC had played an important role in the considered development of the San Ramon Valley. Thus, this decision is far too important to be rushed, and I believe the public has a right to advance notification before a decision is reached by the Board of Supervisors. Placing a safety net .around open land is possible, feasible, and legal rather then offering to land developers the long open lands so that for the many prior generations and well as future generations can and will enjoy the open land. We cant place. a structure on every square foot of possible land which will ultimately impact us all in one way or the other. Pioneer families came here for the beautify and the openness 'of the area to live and protect it because this is what they saw.- Certainly, this view is stil shared and respected by today's families and representatives. Why must we destroy that inheritance; just for money, wealth, power? Pretty much all the same thing. An organization from the grass roots has functioned for 30 years here and there is no real need to replace it; there is no added cost to keep it; there is more direct due process when issues. are evaluated at the grass root level and then forwarded to the county. Actually saving the county time, effort, and bodies to do the ground work. So, to eliminate is like cutting off one of your limbs, and for what gain? Who or what gains to eliminate? Who or what gains to maintain? The county benefits directly and financially with no increased costs. Input follows a very close direct line of due process from local constituents directly from one area to the county via local representatives from a specific area. How more democratic can this process be? Its an excellent example of grass roots effort. A classic example was the 4strosky project on Livorna road by the i freeway, that was supposed to be Senior housing, and approved under those conditions . Now we find that the : state will not allow anything less than 35 units for senior housing requirements! Who is watching out for us on a situation like this??? To say a county supervisor appointed county planning commission will take the place of our local planning commission is beyond belief that we will be,adequately protected on projects corning before you! ! ! Do not take away the regional planning committee!
