SPECIFIC REQUEST(S)OR RECOMMENDATION(S).&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
ADOPT Resolution 2007/ 31 APPROVE Side Letter of Agreement between the County and Public Employees
Union, Local One granting the continuation of holiday compensation pay for the classification of the Glassy Wing Sharp
Shooter(GWSS) Specialist- Project(139W3). The Department requests retro pay for Memorial Day and Independence Day
for the Glassy Wing Sharp Shooter classification.
BACKGROUND:
The Glassy Wing Sharp Shooter (GWSS) Specialist- Project (139W3) classification was established in April of 2001. Upon
establishment, this classification, as well as the Pest Detection Specialist-Project (139W11) classification, was paid in
accordance'to Section 58.1.0 Agricultural Personnel, of the Public Employees Union, Local One Memorandum of
Understanding (MOU), which states that classification (139W3) "shall be paid for eight (8) hours on any recognized County
holiday that occurs in a month where they are in a pay status for eight(8) hours on each work day in that month.
Not requesting that the GWSS Specialists classification be included in the MOU language of Section 58.1.0 was an
oversight by the Department when the position was established. Recently, the Auditor's Office ceased paying the Glassy
Wing Sharp Shooter (GWSS) Specialist-Project (139W3) classification holiday compensation pay; thus, the Agriculture
Department created and jointly signed a side letter with Public Employees Union, Local One, requesting continuance of
payment for the Glassy Wing Sharp Shooter classification.
FISCAL IMPACT:
There is no increase to net county cost as holiday pay for those holding position is budgeted in th ontract ith the
California Department of Food and Agriculture and is thus billed to the as direct program cost.

BE IT RESOLVED that the Contra Costa County Board of Supervisors, in its capacity as
governing Board of the County of Contra Costa and all districts of which it is ex-officio
governing Board, hereby grants APPROVAL of the Side Letter of Agreement between Contra
Costa County and Public Employees Union, Local One.
The Side Letter of Agreement grants the continuation of holiday compensation pay for the
classification of the Glassy Wing Sharp Shooter (GWSS) Specialist- Project (B9W3) at the
rate of eight (8) hours on any recognized County holiday that occurs in a month where they
are in a pay status for eight (8) hours on each work day in that month. In those months in
which the employees are continuously employed, both at the beginning and the end of the
month, but are not in a pay status of eight (8) hours on each work day, they shall be paid a pro
rata share of the eight (8) hours holiday pay based on the portion of the work hours in the
month that they were in a pay status.

Dear Mr. Schlant:
This side letter is to confirm that until recently the Glassy Wing Sharp Shooter (GWSS)
Specialist-Project (B9W3) classification received compensation for eight (8) hours
holiday pay in accordance with Section 58.1.C, Agricultural Personnel.
The Glassy, Wing Sharp Shooter classification will continue to receive eight (8) hours
holiday pay on any recognized County holiday that occurs in a month where they are.in
a pay status for eight (8) hours on each work day in that month. In those months in
which the employees are continuously employed, both at the beginning and the end of
the month, but are not in a pay status for eight (8) hours on each work day, they shall be
