HomeMy WebLinkAboutMINUTES - 12111984 - 1.27 TO: BOARD OF SUPERVISORS Contra FROM: Phil Batchelor, County Administrator Costa DATE: December 5, 1984 County SUBJECT: Reallocation of Family Law Commissioner and Juvenile Court Referees from Current Flat Salary Rate to a Three-Step Range SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION It is recommended that the Board of Supervisors approve the attached resolution which reallocates the classes of Family Law Commissioner and Juvenile Court Referee from a current flat salary rate which is equivalent to 75% of a Superior Court Judge ' s salary to a three-step salary range with a top step equivalent to 850 of a Superior Court Judge 's salary. BACKGROUND Over the past year, staff from my office has reviewed the salaries of the Family Law Commissioner and Juvenile Court Referees at the request of the Superior Court. On behalf of the Court, the Court Administrator requested a salary adjustment for the Family Law Commissioner and Juvenile Court Referees so that these positions would achieve parity with the Municipal Court Commissioners. Presently the salary for the Family Law Commissioner and Juvenile Court Referees are a flat salary rate equivalent to 75% of a Superior Court Judge ' s salary, while a Municipal Court Com- missioner' s salary is a five-step salary range with a top step equivalent to 85% of a Superior Court Judge' s salary. The Superior Court Administrator advises that the Family Law Commissioner and Juvenile Court Referees routinely preside over complex and very stressful and emotional situations. Traffic and small claim matters heard by the Municipal Court Commissioner are generally considered less difficult than such cases although the volume, and repetitive nature, are also stressful. In addition to the internal salary inequity which exists between the Superior Court, Family Law Commissioner and Juvenile Court Referees and the Municipal Court Commissioner_ , a survey of the largest Superior Courts in the state indicates that Contra Costa County is the only county now compensating its Superior Court Commissioner and Juvenile Referees at the 75% salary level. Of the nine other counties included in the survey, in four counties the Commissioner' s salary was equivalent to 85% of the Superior Court Judge' s salary, in three counties the Commissioner' s salary was equivalent to 80%-83..5% of a Superior Court Judge ' s salary, and the remaining two counties were advancing legislation to adjust the salaries of their commissioners to 85% and 80% of a Superior Court Judge' s salary. SUBJECT: In the Matter of Salary Ranges for Family Law Commissioner and RESOLUTION NO. 84/ 7 50 Juvenile Court Referee THE CONTRA COSTA COUNTY BOARD OF SUPERVISORS RESOLVES that effective December 5, 1984: 1. The exempt classifications of Family Law Commissioner (2RS2) and Juvenile Court Referee (2RS1) are allocated to a three step salary schedule of five percent (5%) incremental steps with the third step equivalent to 85% of the salary of a Superior Court Judge in Contra Costa County; and 2. Current incumbent Family Law Commissioner, James Libbey (employee #21356) and incumbent Juvenile Court Referees, Stephen Easton (employee #25281) and Michael Coleman (employee #25954) are reallocated to the first step of the newly established three step schedule; and 3. Janaury 1, 1985 is established as the anniversary date for James Libbey as Family Law Commissioner and for Stephen Easton and Michael Coleman as Juvenile Court Referees; and 4.
